【摘要】：取得時(shí)效的存廢在我國(guó)歷來存在很大爭(zhēng)議。最新的《民法總則專家建議稿》(征求意見稿)規(guī)定了取得時(shí)效,引發(fā)了新一輪討論。但是反對(duì)者大多在未能理解取得時(shí)效獨(dú)立性及構(gòu)成要件之基礎(chǔ)上對(duì)其進(jìn)行批判,實(shí)不可取。隨著社會(huì)的發(fā)展、現(xiàn)代物權(quán)法的價(jià)值化、社會(huì)化以及完善不動(dòng)產(chǎn)登記制度的需要,取得時(shí)效將進(jìn)一步發(fā)揮其穩(wěn)定社會(huì)秩序、解決實(shí)際問題的作用。
[Abstract]: the existence and abolition of the acquisitive prescription has always been very controversial in our country. The latest draft of the general principles of civil law (solicit draft) provides a new round of discussion. However, most of the opponents criticize it on the basis of failure to understand the independence and the constitutive requirements. With the development of society, the value and socialization of modern property law and the need of improving the real estate registration system, the acquisitive prescription will further play its role in stabilizing social order and solving practical problems.
