法的世界肇始于語(yǔ)言,要將法律外化于形則離不開語(yǔ)言。法律表述的過(guò)程是運(yùn)用語(yǔ)言符號(hào)將法律規(guī)范物化成法典,即通過(guò)準(zhǔn)確嚴(yán)謹(jǐn)?shù)那苍~造句以及合理規(guī)范的布局謀篇,實(shí)現(xiàn)立法內(nèi)容與立法語(yǔ)言形式的統(tǒng)一。立法語(yǔ)言作為規(guī)范性語(yǔ)言變體,在詞法、句法及謀篇等方面都具有自身的特點(diǎn)。縱觀眾多立法文本的研究,多數(shù)學(xué)者在詞法和句法方面頗有建樹;鑒于立法文本的謀篇機(jī)制,學(xué)者們大都從顯性的銜接機(jī)制入手,而少有對(duì)立法文本的連貫性進(jìn)行研究,本文通過(guò)引入認(rèn)知框架的視角研究英語(yǔ)立法文本的語(yǔ)篇連貫;鑒于香港特別行政區(qū)具有由來(lái)已久的雙語(yǔ)立法實(shí)踐,故本文借助香港英文立法權(quán)威文本,挖掘出決定英語(yǔ)立法語(yǔ)篇連貫性的認(rèn)知因素,以期能豐富英語(yǔ)立法文本方面的研究并指導(dǎo)立法文本翻譯實(shí)踐。
