《中華人民共和國(guó)勞動(dòng)合同法》(以下簡(jiǎn)稱《勞動(dòng)合同法》)屬于法律文本,涉及勞動(dòng)關(guān)系的各方面,是法律體系的重要組成部分。在當(dāng)今社會(huì)中,占有重要地位,但對(duì)于這樣重要的文本,針對(duì)其進(jìn)行的語(yǔ)言學(xué)研究還不多,尤其是還沒有從情態(tài)人際功能的角度展開過研究。本文以功能語(yǔ)法中人際功能理論中情態(tài)系統(tǒng)和情態(tài)的分類為理論支撐,探究了《勞動(dòng)合同法》中情態(tài)系統(tǒng)的人際功能。 韓禮德和馬西·塞斯(1997)認(rèn)為:人際元功能是講話者與聽話者之間的相互作用,是一種語(yǔ)法資源(即相互聯(lián)結(jié)的系統(tǒng)網(wǎng)絡(luò)),用于在交際過程中,就一般而言,社會(huì)角色的扮演,尤其是言語(yǔ)角色的扮演,即用于建立、改變、保持人際關(guān)系。人際元功能中主要的語(yǔ)法系統(tǒng)是情態(tài)。它包含了講話者對(duì)信息真實(shí)度的評(píng)價(jià)及對(duì)陳述的態(tài)度。 本文通過對(duì)情態(tài)的類型、取向、取值,情態(tài)的實(shí)現(xiàn)方式四方面研究了本法律語(yǔ)篇的情態(tài)系統(tǒng),旨在揭示在法律語(yǔ)篇中情態(tài)系統(tǒng)表達(dá)的特點(diǎn)。研究發(fā)現(xiàn):在《勞動(dòng)合同法》情態(tài)系統(tǒng)中,情態(tài)類型基本是意態(tài)化的表達(dá);情態(tài)取向均為客觀性;在情態(tài)取值上,分別為高值和低值;情態(tài)的實(shí)現(xiàn)方式為情態(tài)動(dòng)詞。研究的意義在于加深我們對(duì)《勞動(dòng)合同法》的理解和把握,有助于立法者更好的利用情態(tài)意義來維護(hù)法律的客觀性。本研究有利于補(bǔ)充與完善法律語(yǔ)篇教學(xué)重點(diǎn)和教學(xué)內(nèi)容。
