【摘要】：“過勞死”作為一個(gè)現(xiàn)階段中國社會(huì)中重要的社會(huì)問題，常常見諸于報(bào)端。每年不斷刷新的年齡記錄與逐年增加的數(shù)據(jù)，無時(shí)無刻不在提醒著我們“過勞死”已經(jīng)成為了一個(gè)亟待解決的社會(huì)難題。但在這個(gè)社會(huì)問題之后浮現(xiàn)的，卻是我國勞動(dòng)法立法與司法的缺失。在目前的勞動(dòng)法立法中，存在著工時(shí)制度、最低工資制度以及工會(huì)制度中規(guī)定的種種不合理，而這些因素的交織加上21世紀(jì)以來我國經(jīng)濟(jì)的巨大飛躍，發(fā)展速度的加快，綜合產(chǎn)生了勞動(dòng)者工作壓力加大，以及“過勞死”的頻發(fā)。有鑒于此，，本文通過從“過勞死”的概念入手進(jìn)行分析，剖析了“過勞死”頻發(fā)的種種法律原因，也列舉了目前實(shí)踐中勞動(dòng)者發(fā)生“過勞死”之后的維權(quán)難，并且從勞動(dòng)法、工會(huì)法等視角，提出了解決目前“過勞死”現(xiàn)象頻發(fā)以及法律無從規(guī)制的建議。
[Abstract]:Death from overwork, as an important social problem in Chinese society at the present stage, is often seen in the press. The new age record and the increasing data every year remind us that "overwork death" has become an urgent social problem to be solved all the time. However, after this social problem, it is the lack of labor law legislation and judicature in our country. In the current labor law legislation, there are all kinds of unreasonable provisions in the working hours system, the minimum wage system and the trade union system, and the interweaving of these factors, coupled with the great leap of our economy since the 21st century, accelerates the speed of development. Comprehensive production of workers work pressure increased, as well as "overwork death" frequent. In view of this, through the analysis of the concept of "overwork death", this paper analyzes the various legal reasons for the frequent occurrence of "overwork death", and also enumerates the difficulties in safeguarding the rights of workers after the occurrence of "overwork death" in practice, and from the labor law, From the perspective of trade union law, this paper puts forward some suggestions to solve the frequent occurrence of "overwork death" and the inability of law to regulate it.
