我國勞動(dòng)者病假保障制度的問題及完善

【摘要】:當(dāng)前我國勞動(dòng)者病假保障制度存在的問題主要包括病假期限計(jì)算不合理、病假工資負(fù)擔(dān)主體不妥當(dāng)、病假工資金額設(shè)定不科學(xué)、病假期內(nèi)勞動(dòng)者社會(huì)保險(xiǎn)費(fèi)負(fù)擔(dān)太沉重以及用人單位支付醫(yī)療補(bǔ)助費(fèi)無依據(jù)等五個(gè)方面。為了切實(shí)保障勞動(dòng)者的合法權(quán)益,合理調(diào)整政府、用人單位和勞動(dòng)者三方關(guān)系,立法有必要重新設(shè)定病假期限及計(jì)算方式、合理界定病假工資在社會(huì)保障部門和用人單位之間的負(fù)擔(dān)、按照效率與公平原則科學(xué)確定病假工資金額、適當(dāng)減免病假期內(nèi)勞動(dòng)者負(fù)擔(dān)的社會(huì)保險(xiǎn)費(fèi),徹底廢除用人單位支付醫(yī)療補(bǔ)助費(fèi)的規(guī)定。
[Abstract]:The problems existing in our country's sick leave protection system mainly include unreasonable calculation of sick leave period, improper main body of sick leave pay burden, and unscientific setting of sick leave salary amount. Sick leave laborer social insurance premium burden is too heavy and employer pays medical subsidy fee without basis and so on five aspects. In order to effectively protect the legitimate rights and interests of workers and rationally adjust the tripartite relationship between the government, the employing unit and the laborer, it is necessary to re-set the period of sick leave and the mode of calculation by legislation. Reasonable definition of the burden of sick leave pay between social security departments and employers, scientific determination of the amount of sick leave pay in accordance with the principle of efficiency and equity, and appropriate reduction of social insurance premiums borne by workers during sick leave, Completely abrogate the stipulation that unit of choose and employ persons pays medical subsidy fee.
