試論我國(guó)勞務(wù)派遣法律制度的現(xiàn)狀與完善

【摘要】:20世紀(jì)90年代以來(lái),經(jīng)濟(jì)全球化不僅直接影響世界經(jīng)濟(jì)的格局和發(fā)展,同時(shí)也給政治和社會(huì)生活帶來(lái)巨大影響。作為社會(huì)政策的重要內(nèi)容——?jiǎng)趧?dòng)關(guān)系勢(shì)必成為受全球影響化影響最為深刻的領(lǐng)域之一。 勞務(wù)派遣法律制度是突破典型勞動(dòng)關(guān)系的新型雇傭模式,它在國(guó)外的發(fā)展已經(jīng)日趨成熟,然而在中國(guó)勞務(wù)派遣雖然也興隆壯大,但是作為一種特別的法律關(guān)系卻存在諸多問(wèn)題和弊端。因此,如何將目前已經(jīng)頗具規(guī)模的勞務(wù)派遣扶上正軌,真正為廣大的受派遣員工謀求全面保障,同時(shí)又能促進(jìn)中國(guó)的雇傭市場(chǎng)更具活力,這是中國(guó)立法者和政府管理部門(mén)孜孜以求的遠(yuǎn)大目標(biāo),也是筆者本文將從勞務(wù)派遣法律關(guān)系的由來(lái)和發(fā)展以及其在中國(guó)的發(fā)展中出現(xiàn)的問(wèn)題及我們值得嘗試的解決方法逐一闡釋和分析。 本文共分為五章,安排如下: 第一章,介紹了勞務(wù)派遣法律制度的定義,派遣關(guān)系中的三方法律關(guān)系,勞務(wù)派遣在中國(guó)興隆發(fā)展的原因以及勞務(wù)派遣法律關(guān)系與其他類似的法律關(guān)系的對(duì)比和差異分析。 第二章,介紹全球勞務(wù)派遣法律制度發(fā)達(dá)地區(qū)的理論研究和實(shí)踐經(jīng)驗(yàn),主要包括美國(guó)、日本和歐美三個(gè)國(guó)家和地區(qū)的勞務(wù)派遣法律制度及其對(duì)我國(guó)派遣法律制度的氣勢(shì)和幫助。 第三章,從闡述我國(guó)勞務(wù)派遣法律制度的現(xiàn)狀入手,分析目前我國(guó)勞務(wù)派遣法律制度中多種不當(dāng)派遣的形式及其產(chǎn)生的動(dòng)因,從而進(jìn)一步闡明該等不當(dāng)派遣給勞務(wù)派遣業(yè)態(tài)所帶來(lái)的諸多問(wèn)題。 第四章,評(píng)析我國(guó)目前對(duì)于勞務(wù)派遣法律制度的立法狀況,同時(shí)結(jié)合最新的第一手信息《派遣規(guī)定(草案)》進(jìn)一步分析我國(guó)今后派遣立法的動(dòng)向和規(guī)律。 第五章,結(jié)合前面的勞務(wù)派遣法律制度的諸多問(wèn)題,圍繞派遣機(jī)構(gòu)規(guī)范化、派遣員工權(quán)益保護(hù)、派遣爭(zhēng)議有效解決以及派遣專項(xiàng)立法等方面提出相應(yīng)的改善建議。
[Abstract]:Since 1990s, economic globalization has not only directly affected the pattern and development of world economy, but also brought great influence to political and social life. As an important part of social policy, labor relations is bound to become one of the most deeply affected areas of global influence. The legal system of labor dispatch is a new type of employment mode which breaks through the typical labor relations. Its development abroad has become more and more mature. However, as a special legal relationship, there are many problems and drawbacks. Therefore, how to put the already large-scale labor dispatch on the right track, and really seek comprehensive protection for the vast number of dispatched employees, and at the same time promote the employment market in China to be more dynamic, This is an ambitious goal pursued by Chinese legislators and government administrations. It is also the author of this paper from the origin and development of the legal relationship of labor dispatch, as well as its problems in the development of China and the solutions we should try to explain and analyze one by one. This paper is divided into five chapters, arranged as follows: the first chapter introduces the definition of the legal system of labor dispatch, the tripartite legal relationship in the dispatch relationship. The reasons for the booming development of labor dispatch in China and the comparison and difference between the legal relationship of labor dispatch and other similar legal relations are analyzed. The second chapter introduces the theoretical research and practical experience of the developed regions of the global labor dispatch legal system, mainly including the three countries and regions of the United States, Japan, Europe and the United States and Europe and the United States, and the momentum and help to China's dispatch legal system. The third chapter, starting with the current situation of the legal system of labor dispatch in China, analyzes the forms and causes of improper dispatch in the current legal system of labor dispatch in our country. It further clarifies the problems brought about by these improper dispatch to the labor dispatch business. In the fourth chapter, the author analyzes the current legislative situation of the legal system of labor dispatch in our country, and further analyzes the trend and law of the dispatch legislation in China in the light of the latest firsthand information < dispatch regulations (draft) >. The fifth chapter, combined with the legal system of labor dispatch in front of many problems, around the dispatch organization standardization, dispatch staff rights and interests protection, dispatch dispute effective resolution and dispatch special legislation and other aspects of the corresponding improvement suggestions.
