【摘要】：為使因工作遭受事故傷害或患職業(yè)病的非法用工單位傷亡人員能夠獲得醫(yī)療救治和經(jīng)濟補償,國務(wù)院《工傷保險條例》第63條和勞動保障部《非法用工單位傷亡人員一次性賠償辦法》作出了相關(guān)規(guī)定。然而從以下兩個案例可以看出,在實際操作過程中,勞動爭議仲裁機構(gòu)和法院在處理非法用工單位傷亡人員一次性賠償爭議案件時還存在一些問題。如非法用工單位與其職工建立的是否勞動關(guān)系問題;在處理非法用工單位傷亡人員一次性賠償爭議中是否需要工傷認(rèn)定問題;非法用工行為的法律責(zé)任問題,等等。如何解決存在的問題更好地落實法規(guī)政策,切實維護勞動者的合法權(quán)益,本刊在此組織討論。
[Abstract]:In order to enable the casualties of illegal employment units who suffer from accidents or occupational diseases at work to receive medical treatment and financial compensation, Article 63 of the regulations on Industrial injury Insurance of the State Council and the one-off compensation measures for casualties of illegal employment units by the Ministry of Labor and Security make relevant provisions. However, it can be seen from the following two cases that there are still some problems in the labor dispute arbitration institution and the court in dealing with the dispute case of one-off compensation for the casualties of the illegal employment unit. If illegal employment unit and its worker establish whether labor relation problem; whether need inductrial injury cognizance problem in dealing with illegal employment unit casualty personnel one-time compensation dispute; the legal liability problem of illegal employment act and so on. How to solve the existing problems and better implement laws and regulations and protect the legitimate rights and interests of workers, this paper discusses here.
