平等就業(yè)權(quán)的民事司法救濟(jì)研究
[Abstract]:Employment is the foundation of people's livelihood and the policy of Anbang, and equal employment is an extremely important content of equal value in modern society and a fundamental way to guarantee the basic rights of human beings. However, at present, there is a double dilemma of poor employment and employment inequality. Among them, the negative impact and destructive force caused by the employment inequality is overall, far more serious than we thought, the employment inequality is the most prominent manifestation of the current social inequality. With the rise of the concepts of "harmonious society", "ruling for the people", "people-oriented" and "scientific development view", it has become a widespread social consensus that all workers share the fruits of reform and development fairly. And equal employment is the basic way to achieve this basic goal. It is in this sense that the right to equality in employment, which is both a simple civilian scenario and a major issue of social justice and legal significance, is related to the democratization, diversity and equality of opportunity in the workplace. It is no longer a simple declaration of rights, but a positive claim, which is the most common interest demand of the broad masses of workers. This paper studies the judicial remedy of equal employment right from three aspects: the method of typology, the method of comparative study, the method of semantic analysis and the method of normative analysis. The first part, the concept of equal employment right, the status quo, the significance of relief are studied. In the second part, the author studies the substantive law issues involved in the relief process of equal employment right, including the scope of the right subject, the definition and standard of discrimination and the related legal liability. The third part studies the judicial remedy of equal employment right from the aspect of procedural law. The main contents include: the system of filing and examination, the problem of subject's suitability and the problem of burden of proof. The author thinks that in order to change the status quo of equal employment right, we need to make the Anti-Employment Discrimination Law in the aspect of substantive law, and reform the current filing and examining system in the aspect of procedure. According to the particularity of equal right to employment, the distribution system of burden of proof is established.
