分享經(jīng)濟(jì)中用工關(guān)系的中美法律比較及啟示

【摘要】:隨著分享經(jīng)濟(jì)的發(fā)展,產(chǎn)生了用工中勞動(dòng)關(guān)系認(rèn)定等法律問題。通過對中美兩國勞動(dòng)關(guān)系范圍、認(rèn)定標(biāo)準(zhǔn)、判定理論、勞動(dòng)爭議裁決過程以及勞動(dòng)法主導(dǎo)原則的比較,發(fā)現(xiàn)美國雇傭法律制度的可借鑒之處。但同時(shí)發(fā)現(xiàn),兩國法律共同面臨著制度供給的不足。針對發(fā)展經(jīng)濟(jì)鼓勵(lì)創(chuàng)新與保護(hù)勞工兩個(gè)理念的沖突,提出了應(yīng)確立公共利益原則,實(shí)現(xiàn)公平與效益的均衡;針對我國勞動(dòng)關(guān)系認(rèn)定標(biāo)準(zhǔn)存在的不足,提出了應(yīng)考慮非標(biāo)準(zhǔn)勞動(dòng)關(guān)系的特征以及實(shí)現(xiàn)認(rèn)定標(biāo)準(zhǔn)的指標(biāo)化。
[Abstract]:With the development of sharing economy, legal problems such as labor relationship identification in employment have emerged. Through the comparison of the scope of labor relations between China and the United States, the standard of determination, the theory of judgment, the process of labor dispute adjudication and the guiding principle of labor law, the author finds that the employment law system of the United States can be used for reference. But at the same time, the law of the two countries are faced with the shortage of institutional supply. In view of the conflict between the two concepts of encouraging innovation and protecting labor in developing economy, this paper puts forward that the principle of public interest should be established to realize the balance between fairness and benefit, and that the standard of labor relations should be recognized in our country. The characteristics of non-standard labor relation and the index of realizing the standard are put forward.
