導游人員勞動關(guān)系法律問題研究

【摘要】:如何確定導游人員勞動關(guān)系歸屬,進而保護導游人員的勞動權(quán)益,一直是勞動法理論研究和司法實踐領(lǐng)域中的重要問題及難題。在我國勞動法理論中,普遍認為導游人員是勞動法意義上的勞動者,但是由于導游人員工作閑忙季明顯,體力腦力要求高,職業(yè)危險性高等特點,又有著區(qū)別于普通勞動者的鮮明特征。本文以勞動關(guān)系理論為基礎(chǔ),以68例導游人員與用人單位發(fā)生勞動爭議的案例為切入點,試圖分析現(xiàn)行勞動法體系在調(diào)整導游人員勞動關(guān)系時出現(xiàn)的功能性障礙,并展現(xiàn)司法審判機關(guān)在案件審理過程中的法律思維和判斷邏輯,F(xiàn)行立法調(diào)整導游人員勞動關(guān)系的功能性障礙在于,忽視了現(xiàn)實生活中導游人員構(gòu)成體系的復雜性,模糊了承擔導游注冊管理功能的機構(gòu)的法律性質(zhì)。法院在實際操作中并無統(tǒng)一體系來認定各類導游人員勞動關(guān)系的歸屬,對于勞動關(guān)系的認定標準的司法實踐運用體現(xiàn)出較大差異。我國現(xiàn)行立法無法在旅游業(yè)高速發(fā)展的進程中充分發(fā)揮保護導游人員勞動權(quán)益的作用。因此,設(shè)立專門的調(diào)整導游人員勞動關(guān)系的法律規(guī)范顯得尤為重要,一方面,在立法層面需要對導游人員構(gòu)成體系的復雜性做出回應,針對不同類別導游需要明確其勞動關(guān)系的歸屬;另一方面,我國立法層面需要對導游人員的勞動權(quán)益訴求做出回應,如工資給付要求、繳納社會保險、工傷待遇要求等,加大對導游人員的保護力度。在研究方法層面,本文采用了文獻研究的方法、法解釋學的方法、歷史研究的方法、案例分析的方法等研究方法;本文創(chuàng)新之處在于選取了68例與論點高度相關(guān)的案例,采用實證研究的方法:一方面,詳細說明司法審判機關(guān)審理導游人員勞動關(guān)系案件的情況,另一方面,體現(xiàn)出導游職業(yè)群體對勞動權(quán)益的特殊訴求內(nèi)容。并創(chuàng)造性地提出有利于明確導游人員勞動關(guān)系歸屬的方法,以及解決導游職業(yè)群體勞動權(quán)益特殊訴求的建議。
[Abstract]:How to determine the labor relationship of tour guides and then protect their labor rights and interests has always been an important problem and difficult problem in the field of labor law theory research and judicial practice. In the theory of labor law in our country, it is generally believed that tour guides are workers in the sense of labor law. However, because of the obvious busy working season, the high demands of physical and mental strength, the high occupational danger and so on, Also has the distinct characteristic which distinguishes from the ordinary laborer. Based on the theory of labor relations and 68 cases of labor disputes between tour guides and employers, this paper tries to analyze the functional obstacles in adjusting the labor relations of tour guides in the current labor law system. And shows the judicial organs in the trial process of the legal thinking and judgment logic. The functional obstacle of the current legislation to adjust the labor relations of tour guides lies in the neglect of the complexity of the structure of tour guides in real life and the blurring of the legal nature of the organizations that undertake the functions of registration and management of tour guides. The court does not have a unified system to determine the ownership of the labor relations of all kinds of tour guides in the actual operation, and the judicial practice of determining the standard of labor relations reflects great differences. The current legislation of our country can not fully play the role of protecting the labor rights and interests of tour guides in the process of rapid development of tourism industry. Therefore, it is particularly important to set up a special legal norm to adjust the labor relations of tour guides. On the one hand, it is necessary to respond to the complexity of the tour guide composition system at the legislative level. On the other hand, at the legislative level, China needs to respond to the demands of tour guides' labor rights and interests, such as wage payment, social insurance, work-related injury treatment and so on. Strengthen the protection of tour guides. In the aspect of research methods, this paper adopts the methods of literature research, the method of legal hermeneutics, the method of historical study, the method of case analysis, etc. The innovation of this paper lies in the selection of 68 cases which are highly related to the argument. On the one hand, it explains in detail the cases of labor relations of tour guides in the judicial organs; on the other hand, it reflects the special demands of tour guides' professional groups on labor rights and interests. In addition, the author creatively puts forward some methods to clarify the labor relationship of tour guides, and some suggestions to solve the special demands of tour guides' labor rights and interests.
