家政服務(wù)機(jī)構(gòu)的民事責(zé)任問題研究

【摘要】: 近年來,有關(guān)家政服務(wù)機(jī)構(gòu)的糾紛層出不斷,“富平家政案”、“三八家政服務(wù)中心案”等類似案件的出現(xiàn)更是引起人們的廣泛關(guān)注。家政服務(wù)業(yè)與人們的日常生活密切相關(guān),家政服務(wù)機(jī)構(gòu)對(duì)整個(gè)行業(yè)的發(fā)展起著重要的推動(dòng)作用,準(zhǔn)確界定家政服務(wù)機(jī)構(gòu)的法律責(zé)任是確保家政服務(wù)業(yè)健康迅速發(fā)展的前提和保障。 本文運(yùn)用類型化分析的研究方法,結(jié)合現(xiàn)實(shí)實(shí)踐中的典型個(gè)案,從不同家政服務(wù)機(jī)構(gòu)的法律定性出發(fā),分析其與家政服務(wù)員、客戶之間的不同法律關(guān)系,界定其應(yīng)當(dāng)承擔(dān)的民事責(zé)任,并對(duì)責(zé)任承擔(dān)的具體范圍與限制等相關(guān)問題進(jìn)行較深入地探討。 本文除引言和結(jié)語外,共分四部分。 第一部分家政服務(wù)機(jī)構(gòu)的分類及法律性質(zhì)。在該部分中,首先依據(jù)運(yùn)營模式的不同,將現(xiàn)有家政服務(wù)機(jī)構(gòu)分為員工制、會(huì)員制、中介制三種類型;其次分析三種模式家政服務(wù)機(jī)構(gòu)法律上的性質(zhì),并將其劃分為居間型和雇傭型家政服務(wù)機(jī)構(gòu)兩種類型。 第二部分析不同類型家政服務(wù)機(jī)構(gòu)與其家政服務(wù)員及客戶之間的法律關(guān)系。居間型家政服務(wù)機(jī)構(gòu)與家政服務(wù)員和客戶之間是居間人與委托人或居間人與第三人的關(guān)系,依據(jù)我國《合同法》關(guān)于居間合同的相關(guān)規(guī)定,居間型家政服務(wù)機(jī)構(gòu)對(duì)家政服務(wù)員及客戶負(fù)有居間人義務(wù)。雇傭型家政服務(wù)機(jī)構(gòu)與家政服務(wù)員之間形成雇傭關(guān)系或勞動(dòng)法律關(guān)系,與客戶之間形成類似于派遣合同的特殊家政服務(wù)合同關(guān)系,而雇傭型家政服務(wù)員與客戶之間基于服務(wù)合同也形成事實(shí)上的雇傭關(guān)系。這使得雇傭型家政服務(wù)機(jī)構(gòu)運(yùn)營模式下存在雙重雇傭關(guān)系,也導(dǎo)致了雇傭型家政服務(wù)機(jī)構(gòu)責(zé)任認(rèn)定的特殊性。另外在本部分,還對(duì)近來影響較大的“富平家政案”及“三八家政服務(wù)中心案”中相關(guān)家政服務(wù)機(jī)構(gòu)的法律性質(zhì)及相關(guān)主體之間的法律關(guān)系進(jìn)行了較詳細(xì)的分析。 第三部分具體討論家政服務(wù)機(jī)構(gòu)的民事責(zé)任問題。居間型家政服務(wù)機(jī)構(gòu)負(fù)有居間人義務(wù),其主要是如實(shí)報(bào)告義務(wù)。對(duì)于如實(shí)報(bào)告義務(wù),筆者認(rèn)為應(yīng)當(dāng)包括積極調(diào)查義務(wù)的內(nèi)容,并且過失提供虛假情況也構(gòu)成如實(shí)報(bào)告義務(wù)的違反。違反如實(shí)報(bào)告義務(wù)的法律責(zé)任主要包括:不得請(qǐng)求居間報(bào)酬、承擔(dān)損害賠償責(zé)任。雇傭型家政服務(wù)機(jī)構(gòu)承擔(dān)的是雇主責(zé)任,但由于其中雙重雇傭關(guān)系的存在,使其雇主責(zé)任具有特殊性:在特定情況下雇傭型家政服務(wù)機(jī)構(gòu)與客戶承擔(dān)連帶責(zé)任。另外在此部分,筆者考慮到現(xiàn)實(shí)中家政服務(wù)機(jī)構(gòu)的具體情況,對(duì)于與家政服務(wù)員形成勞動(dòng)關(guān)系的雇傭性家政服務(wù)機(jī)構(gòu)所要承擔(dān)的勞動(dòng)法上的用人單位的責(zé)任也進(jìn)行了簡(jiǎn)單分析論述。 第四部分是家政服務(wù)機(jī)構(gòu)的責(zé)任范圍問題。主要是討論家政服務(wù)糾紛中家政服務(wù)機(jī)構(gòu)往往要承擔(dān)不合理的巨額賠償而引起爭(zhēng)議的問題。居間型家政服務(wù)機(jī)構(gòu)的違約責(zé)任受到可預(yù)見性規(guī)則、居間人過錯(cuò)及責(zé)任承擔(dān)能力等方面的限制;雇傭型家政服務(wù)機(jī)構(gòu)的責(zé)任也應(yīng)在賠償數(shù)額、精神損失賠償方面有所限制。
[Abstract]:In recent years, there has been a continuous dispute over domestic service institutions. The emergence of similar cases, such as "the case of domestic affairs in Fuping", "the case of the 38 domestic affairs service center", has aroused widespread concern. Domestic service industry is closely related to people's daily life. Domestic service institutions have played an important role in promoting the development of the whole industry, and it is accurate. Defining the legal responsibility of domestic service agencies is the premise and guarantee for ensuring the healthy and rapid development of domestic service industry.
Using the research method of typed analysis and the typical case in practical practice, this paper analyzes the different legal relations between the housewaiters and the clients from the legal nature of the different domestic service institutions, and defines the civil liability that should be undertaken, and the specific scope and limitation of the responsibility bearing are more profound. Probe into the land.
In addition to the introduction and conclusion, this article is divided into four parts.
The first part is the classification and legal nature of domestic service institutions. In this part, according to the different operating modes, the existing domestic service institutions are divided into three types: employee system, membership system and intermediary system. Secondly, it analyzes the legal nature of the three types of domestic service institutions and divides them into residence type and employment type housekeeping service machine. Construct two types.
The second part analyses the legal relationship between the domestic service agencies of different types and their housekeeper and customers. The third part discusses the civil liability of domestic service institutions. The intermediary domestic service institutions bear the obligations of the resident, which is mainly the true reporting obligation. For the true reporting obligations, the author thinks that the content of the active investigation obligation should be included, and the negligence provides false circumstances and constitutes a violation of the true reporting obligation. The legal responsibility of the actual reporting obligation mainly includes: not requesting interviewing remuneration and taking on the liability for damages. The employment type domestic service institution assumes the employer's responsibility, but because of the existence of the dual employment relationship, the employer's responsibility is special: in certain circumstances, the domestic service institution of the hired servant bears joint responsibilities with the customer. In addition, in this part, the author, taking into account the actual situation of domestic service institutions in the reality, makes a simple analysis and Discussion on the responsibility of the employers in the labor law that should be undertaken by the mercenary service institutions that form labor relations with housekeeping attendants.
The fourth part is the issue of the responsibility range of domestic service institutions. It is mainly the discussion of the disputes caused by domestic service agencies in domestic affairs service disputes, which are often caused by unreasonable huge compensation. The responsibility of the employment type domestic service organization should also be limited in the amount of compensation and the compensation for mental loss.
