勞動(dòng)關(guān)系法律調(diào)整模式論——從《勞動(dòng)合同法》的視角解讀

【摘要】:勞動(dòng)關(guān)系的調(diào)整方式包括個(gè)體自治、團(tuán)體自治和國(guó)家強(qiáng)制。由于勞動(dòng)關(guān)系當(dāng)事人雙方缺乏民事主體平等性和互換性的基礎(chǔ),因此,勞動(dòng)合同中的個(gè)體自治實(shí)際上是雇主單方主導(dǎo)的,對(duì)于勞動(dòng)者而言其自治空間較小。因此,對(duì)勞動(dòng)關(guān)系的調(diào)整不能簡(jiǎn)單地適用私法自治,而需采取多種調(diào)整方式,尤其是強(qiáng)調(diào)團(tuán)體自治和國(guó)家強(qiáng)制,以協(xié)調(diào)勞動(dòng)合同雙方當(dāng)事人的利益以及社會(huì)安全的利益。這一點(diǎn)在新頒布實(shí)施的《勞動(dòng)合同法》上得到了充分體現(xiàn)。
[Abstract]:The adjustment of labor relations includes individual autonomy, group autonomy and state coercion. Due to the lack of equality and interchangeability between the parties to labor relations, the individual autonomy in labor contracts is actually dominated by employers and has less autonomy for workers. Therefore, the adjustment of labor relations can not simply apply private law autonomy, but need to adopt a variety of adjustment methods, especially the emphasis on group autonomy and state coercion, in order to coordinate the interests of both parties to labor contract and the interests of social security. This point has been fully embodied in the newly promulgated Labor contract Law.
