勞動(dòng)利益爭(zhēng)議處理機(jī)制問(wèn)題研究

【摘要】:在勞動(dòng)法理論當(dāng)中勞動(dòng)爭(zhēng)議包含了勞動(dòng)權(quán)利爭(zhēng)議與勞動(dòng)利益爭(zhēng)議。我國(guó)理論界以研究勞動(dòng)權(quán)利爭(zhēng)議居多,并且立法當(dāng)中也以規(guī)制勞動(dòng)權(quán)利爭(zhēng)議為主。相對(duì)來(lái)說(shuō),無(wú)論是理論還是立法實(shí)踐,有關(guān)于勞動(dòng)利益爭(zhēng)議的內(nèi)容還比較少。但是近年來(lái)由于勞動(dòng)利益爭(zhēng)議的凸顯,勞動(dòng)者的權(quán)益在多數(shù)情況下又無(wú)法得到保障,因而,勞動(dòng)利益爭(zhēng)議的內(nèi)涵和外延進(jìn)行準(zhǔn)確界定的基礎(chǔ)上,完善現(xiàn)有的勞動(dòng)爭(zhēng)議處理機(jī)制有必要。筆者首先從勞動(dòng)利益爭(zhēng)議的界定出發(fā),闡述了勞動(dòng)利益爭(zhēng)議的概念、屬性、特征等,并結(jié)合上述內(nèi)容給出了勞動(dòng)利益爭(zhēng)議的定義。在此基礎(chǔ)上,厘清了勞動(dòng)利益爭(zhēng)議與相關(guān)概念的聯(lián)系和區(qū)別。同時(shí)闡述了一般勞動(dòng)利益爭(zhēng)議的的范疇,為下文探討勞動(dòng)利益爭(zhēng)議的多元化處理機(jī)制打下伏筆。在此基礎(chǔ)上筆者就我國(guó)勞動(dòng)利益爭(zhēng)議處理機(jī)制存在的問(wèn)題進(jìn)行探討。分析了我國(guó)現(xiàn)行的勞動(dòng)利益爭(zhēng)議處理機(jī)制,明確了我國(guó)對(duì)權(quán)利爭(zhēng)議及勞動(dòng)利益爭(zhēng)議實(shí)際上是分軌處理的,并闡述了我國(guó)的勞動(dòng)利益爭(zhēng)議的處理方式。接著探討了我國(guó)目前的勞動(dòng)利益爭(zhēng)議處理機(jī)制的存在的問(wèn)題。接著,筆者分別介紹了域外的日本、加拿大、臺(tái)灣等國(guó)家和地區(qū)的立法,及其處理勞動(dòng)利益爭(zhēng)議時(shí)所貫徹的原則,并闡述了各國(guó)及地區(qū)解決集體勞動(dòng)利益爭(zhēng)議的具體制度,歸納總結(jié)了各國(guó)及地區(qū)勞動(dòng)利益爭(zhēng)議處理制度的經(jīng)驗(yàn),以期對(duì)完善我國(guó)集體勞動(dòng)爭(zhēng)議處理機(jī)制作出借鑒作用。最后,分析我國(guó)勞動(dòng)利益爭(zhēng)議處理制度之必要性,借鑒域外經(jīng)驗(yàn),筆者提出來(lái)完善我國(guó)勞動(dòng)利益爭(zhēng)議處理機(jī)制的相關(guān)措施。首先,明確我國(guó)勞動(dòng)利益爭(zhēng)議處理機(jī)制完善的必要性;其次完善勞動(dòng)利益爭(zhēng)議相關(guān)立法;最后是,借鑒國(guó)外經(jīng)驗(yàn)并依據(jù)我國(guó)的實(shí)際情況晚上完善我國(guó)的勞動(dòng)利益爭(zhēng)議處理機(jī)制,包括完善我國(guó)集體協(xié)商制度,勞動(dòng)利益爭(zhēng)議的調(diào)解制度,同時(shí)確立勞動(dòng)利益爭(zhēng)議的仲裁制度并規(guī)定罷工的免責(zé)條款從而對(duì)勞動(dòng)者的罷工進(jìn)行規(guī)制。
[Abstract]:In labor law theory, labor dispute includes labor right dispute and labor interest dispute. The theoretical circle of our country mainly studies the labor right dispute, and in the legislation also mainly regulates the labor right dispute. Relatively speaking, whether in theory or legislative practice, there is less content about labor interest dispute. However, in recent years, because of the prominent labor interest dispute, workers' rights and interests can not be protected under most circumstances. Therefore, the connotation and extension of labor interest dispute are defined accurately. It is necessary to perfect the existing labor dispute handling mechanism. Starting from the definition of labor interest dispute, the author expounds the concept, attributes and characteristics of labor interest dispute, and gives the definition of labor interest dispute combined with the above contents. On this basis, it clarifies the relation and difference between labor interest dispute and related concepts. At the same time, it expounds the category of general labor interest dispute, which lays a good foundation for the discussion of the diversification mechanism of labor interest dispute. On this basis, the author probes into the problems existing in the mechanism of handling labor interest disputes in China. This paper analyzes on the existing mechanism of handling labor interest disputes in our country, clarifies that the disputes of rights and labor interests are actually dealt with separately, and expounds the ways to deal with the disputes of labor interests in our country. Then it discusses the existing problems of labor interest dispute settlement mechanism in our country. Then, the author introduces the legislation of Japan, Canada, Taiwan and other countries and regions, and the principles of handling labor interests disputes, and expounds the specific system of resolving collective labor interests disputes in various countries and regions. This paper sums up the experience of labor interest dispute handling system in various countries and regions in order to perfect the collective labor dispute settlement mechanism in China. Finally, the author analyzes the necessity of the labor interest dispute handling system in China, and draws lessons from the overseas experience, and puts forward the relevant measures to perfect the labor interest dispute settlement mechanism of our country. First of all, to clarify the necessity of perfecting the mechanism of labor interest dispute; secondly, to perfect the relevant legislation of labor interest dispute; finally, to learn from foreign experience and to improve the mechanism of handling labor interest dispute in the evening according to the actual situation of our country. It includes perfecting our collective bargaining system, mediation system of labor interest dispute, and establishing arbitration system of labor interest dispute and stipulating the exemption clause of strike so as to regulate the strike of workers.
