我國(guó)勞務(wù)派遣制度下的同工同酬問(wèn)題研究

【摘要】:勞務(wù)派遣是市場(chǎng)經(jīng)濟(jì)發(fā)展的必然結(jié)果,我國(guó)是一個(gè)人口大國(guó),人力資源豐富,勞動(dòng)力人口過(guò)剩,勞務(wù)派遣這種用工形式對(duì)于緩解我國(guó)就業(yè)壓力,增加就業(yè)崗位,安置下崗、失業(yè)職工及未就業(yè)大學(xué)生方面功不可沒(méi)。但同時(shí),這種用工方式也存在一些缺陷。由于我國(guó)法制不健全,以及勞務(wù)派遣存在派遣機(jī)構(gòu)、用工單位、被派遣勞動(dòng)者三方主體,這種用工形式的特殊性,導(dǎo)致其負(fù)面影響逐漸凸現(xiàn)。勞務(wù)派遣工在用工單位受歧視現(xiàn)象嚴(yán)重,經(jīng)常被稱(chēng)為二等公民,尤其是勞務(wù)派遣工與用工單位正式職工間不能同工同酬,在工資、福利、社保繳納方面常常受到不公平對(duì)待,使職工缺乏安全感,缺乏對(duì)企業(yè)的歸屬感及信任感。 針對(duì)這些現(xiàn)狀,08年實(shí)施的《勞動(dòng)合同法》對(duì)勞務(wù)派遣的概念、適用范圍、派遣機(jī)構(gòu)資質(zhì)、派遣工的保護(hù)等方面都做了專(zhuān)門(mén)規(guī)定,強(qiáng)調(diào)了勞務(wù)派遣工的同工同酬權(quán)以及工資增長(zhǎng)權(quán)利。但是法律不可能窮盡現(xiàn)實(shí)生活中發(fā)生的所有問(wèn)題,隨著這種用工形式的廣泛化,許多問(wèn)題逐漸被暴漏,立法中存在的問(wèn)題也急需解決。 文章分三部分來(lái)討論,第一部分分三節(jié)主要介紹了勞務(wù)派遣及同工同酬的相關(guān)概念及特點(diǎn),對(duì)勞務(wù)派遣的含義、法律關(guān)系及同工同酬的概念作了詳細(xì)的分析和界定,并用專(zhuān)節(jié)對(duì)勞務(wù)派遣這種特殊用工形式下的同工同酬的特點(diǎn)做了專(zhuān)門(mén)的分析。第二部分分三節(jié)主要介紹了我國(guó)勞務(wù)派遣中存在的同工不同酬問(wèn)題,從我國(guó)勞務(wù)派遣制度中存在的同工不同酬現(xiàn)狀及弊端入手,分析這種現(xiàn)象產(chǎn)生的根源,并提出解決同工同酬問(wèn)題的必要性。第三部分分兩節(jié)介紹了我國(guó)現(xiàn)行法律對(duì)勞務(wù)派遣中同工同酬規(guī)定存在的不足及解決策略,就如何實(shí)現(xiàn)勞務(wù)派遣工同工同酬權(quán)提出了具體對(duì)策,以期對(duì)勞務(wù)派遣工同工同酬權(quán)利的實(shí)現(xiàn)有所助益。
[Abstract]:Labor dispatch is the inevitable result of the development of market economy. Our country is a large country with a large population, with abundant human resources and overpopulation of labor force. This form of labor dispatch can relieve the pressure of employment, increase employment posts, and settle laid-off workers in our country. Unemployed workers and underemployed college students can not be ignored. But at the same time, there are some defects in this way. Due to the imperfect legal system in our country, and the existence of dispatch agencies, employment units, and the three main bodies of dispatched workers, the particularity of this form of employment has led to its negative impact. Labor dispatch workers are seriously discriminated against in employment units, and are often referred to as second-class citizens. In particular, labor dispatch workers and formal workers of employment units cannot receive equal pay for equal work. They are often unfairly treated in terms of wages, benefits, and social security payments. So that workers lack security, lack of sense of belonging and trust in the enterprise. In view of these present conditions, the "Labor contract Law", which was implemented in 2008, has made special provisions on the concept, scope of application, qualifications of dispatch agencies, protection of dispatched workers, and so on. The right to equal pay for equal work and the right to wage increase are emphasized. However, the law can not exhaust all the problems in real life. With the widespread use of labor, many problems are gradually broken out, and the problems in the legislation need to be solved urgently. The article is divided into three parts. The first part mainly introduces the related concepts and characteristics of labor dispatch and equal pay for equal work, and makes a detailed analysis and definition of the meaning, legal relationship and the concept of equal pay for equal work. And special section of the special labor dispatch under the form of equal pay for equal work to do a special analysis of the characteristics. The second part is divided into three sections, mainly introduces the problem of equal pay in the dispatch of labor services in our country, starting with the current situation and malpractice of the different pay for equal work in the system of labor dispatch in our country, analyzes the root of this phenomenon. It also puts forward the necessity of solving the problem of equal pay for equal work. The third part is divided into two sections to introduce the shortcomings and solutions of the current law of our country on the equal pay for equal work in the dispatch of labor services, and put forward the specific countermeasures on how to realize the right of equal pay for the dispatch of labor services. With a view to the realization of the right to equal pay for the dispatch of labor.
