【摘要】：目前,國(guó)內(nèi)心理學(xué)服務(wù)市場(chǎng)的法律環(huán)境,總體來(lái)講,無(wú)“法”可依。心理咨詢和心理治療活動(dòng)中可以參照的法律僅有《勞動(dòng)法》、《民法通則》中的部分內(nèi)容,與此相關(guān)的其他法規(guī)、條例等也僅有各地的《精神衛(wèi)生條例》,另外還有一些相關(guān)行業(yè)協(xié)會(huì)頒布的《心理咨詢師國(guó)家職業(yè)標(biāo)準(zhǔn)》,《心理治療與心理咨詢工作者道德規(guī)范準(zhǔn)則》,《心理測(cè)驗(yàn)工作者的道德準(zhǔn)則》等。 我國(guó)法律對(duì)心理咨詢的規(guī)范,還不能適應(yīng)日趨復(fù)雜的社會(huì)經(jīng)濟(jì)活動(dòng),也難以在司法活動(dòng)中體現(xiàn)公平與正義的法律價(jià)值。在中國(guó)心理疾病患者人數(shù)日益增高的今天,我們必須對(duì)心理咨詢及心理治療的法律地位以及其與中國(guó)法律的對(duì)接進(jìn)行反思。 因此,本文從心理咨詢和心理治療的準(zhǔn)入機(jī)制作為切入,參照其他國(guó)家、地區(qū),心理咨詢和心理治療的相關(guān)法律,探討我國(guó)心理咨詢和心理治療如果立法,可以有些什么樣的借鑒。 本文得出以下結(jié)論:(1)立法減少管理頭緒,目前,心理咨詢和治療師出多門,衛(wèi)生部、勞動(dòng)部,建議由一個(gè)部門進(jìn)行統(tǒng)籌,對(duì)今后頒發(fā)的執(zhí)照進(jìn)行統(tǒng)一。(2)建立行業(yè)協(xié)會(huì),用心理行業(yè)協(xié)會(huì)對(duì)心理咨詢、治療進(jìn)行監(jiān)督、管理,以及組織學(xué)術(shù)交流與行業(yè)宣傳。(3)立法明確心理咨詢與心理治療的權(quán)責(zé)所在。并對(duì)心理咨詢和心理治療的立法提出一些個(gè)人見解。
[Abstract]:At present, the legal environment of domestic psychological service market, generally speaking, there is no "law" to rely on. The only laws that can be consulted in counseling and psychotherapy activities are the Labour Code, some of the General principles of Civil Law, and other relevant laws and regulations. There are only the "Mental Health regulations" issued by some relevant trade associations, such as the National Professional Standards for Psychological counsellors, the Code of Ethics for Psychotherapy and Psychological counsellors, and the work of Psychological testing. The moral Code of the Man, et al. The legal norms of psychological counseling in our country can not adapt to the increasingly complex social and economic activities, and it is difficult to embody the legal value of fairness and justice in the judicial activities. With the increasing number of patients with mental illness in China today, we must reflect on the legal status of psychological counseling and psychotherapy and their docking with Chinese law. Therefore, from the perspective of the admission mechanism of psychological counseling and psychotherapy, and referring to the relevant laws of other countries, regions, psychological counseling and psychotherapy, this paper discusses the legislation of psychological counseling and psychotherapy in our country. What kind of reference can be used for reference. This article draws the following conclusions: (1) legislation to reduce the number of management thread, at present, psychological counsellors and therapists out of a number of departments, the Ministry of Health, the Ministry of Labour, suggested by a department to coordinate the future issue of a unified license. (2) the establishment of trade associations, The psychological industry association is used to supervise, manage and organize academic communication and industry propaganda. (3) the power and responsibility of psychological counseling and psychotherapy are clearly defined by legislation. And some personal opinions on the legislation of psychological counseling and psychotherapy are put forward.
