不當勞務派遣的法律規(guī)制

【摘要】:勞務派遣制度最初起源于西方,這種新型用工方式的出現得益于工業(yè)社會經濟的快速發(fā)展,由于其在用工方面具有降低企業(yè)人力資源管理成本、用工靈活以及促進就業(yè)方面具有很大的優(yōu)勢,而被很多國家所采用。自從我國改革開放后,出于其低成本和靈活性等特點而被越來越廣泛的使用。但由于市場主體法律意識淡薄及逐利本性的驅使,以及立法缺陷和執(zhí)法不嚴等原因,導致勞務派遣在我國出現了畸形發(fā)展的態(tài)勢,大量違法違規(guī)或者打法律擦邊球的不當勞務派遣不斷滋生蔓延。現階段,正值我國加大力度的推進依法治國之際,構建社會主義法律體系以及進行經濟結構轉型的關鍵時期,黨的十八屆三中全會提出:“堅持社會主義市場經濟改革方向,以促進社會公平正義、增進人民福祉為出發(fā)點和落腳點”,而且,黨的十八屆四中全會以“依法治國”為主題,明確了“法治中國”的總體建設目標。勞動法作為社會主義法律體系中的重要的部門法,對于維護勞動者的合法權益、平衡社會主義勞動關系甚至是維護社會各階級之間的和諧穩(wěn)定關系具有非常重要的作用。因此,勞動法的完善是社會主義法律體系完善的重要一環(huán)。但由于目前勞動法中有關勞務派遣的法律制度還不夠完善,在實踐中,規(guī)避勞務派遣相關法律制度,實行不當勞務派遣,從而侵犯勞動者合法權益的現象時有發(fā)生。如何完善其法律規(guī)制并避免其社會危害是理論界和實務界必須關注的問題。本論文試圖以此為出發(fā)點,對我國的不當勞務派遣法律規(guī)制的完善進行深入的分析與研究,并提出相關的完善方案。 本論文的主體分為四個部分。第一部分為勞務派遣的基礎理論解析。該部分主要分析了勞務派遣的特點及其在國內及國外的發(fā)展現狀,并對國內外關于勞務派遣法律關系的理論學說進行了梳理。第二部分為不當勞務派遣的表現形式及其社會危害。該部分指出的不當勞務派遣的表現形式,包括公營派遣、合謀派遣、隱名派遣、自設派遣等,,并分析了不當勞務派遣所引發(fā)的社會危害,包括不利于和諧勞動關系的構建、不利于社會的和諧穩(wěn)定、有悖于公平正義的實現等。第三部分在第二部分的基礎上提出了不當勞務派遣法律規(guī)制現存的問題,具體表現在立法存在缺陷與漏洞,包括用工單位與勞動者之間的法律關系尚未明確、勞務派遣企業(yè)的準入及運行法規(guī)不夠完善、被派遣勞動者與正式工同等待遇規(guī)定不夠細化、雇主責任制度不完善,此外還有執(zhí)法監(jiān)督不力等需要進一步細化及解決的問題。第四部分為不當勞務派遣法律規(guī)制的完善建議。不當勞務派遣法律規(guī)制的完善的原則是保護勞動者合法權益原則、在責任分配上的公平原則、多方主體利益平衡原則。在不當勞務派遣法律規(guī)制的完善機制的價值取向上應該傾向于保護作為弱勢群體的勞動者的利益,并且明確不當勞務派遣雇主責任的承擔方式,在此基礎上,通過完善相關立法、強化依法勞動用工理念、強化職能部門的執(zhí)法力度以及通過工會和行業(yè)協(xié)會的保護措施等來完善我國的不當勞務派遣法律規(guī)制,從而使我國的勞務派遣在經濟建設中發(fā)揮積極的作用,并推動對勞動者基本權利的保護,繼而實現社會的公平正義。
[Abstract]:The labor dispatch system originally originated in the West. The emergence of this new mode of employment has benefited from the rapid development of the industrial social economy. Because it has a great advantage in reducing the cost of human resource management, flexible employment and promoting employment, it has been adopted by many countries. Since the reform and opening up of China, Because of its low cost and flexibility, it has been used more and more widely. However, because of the weak legal consciousness of the market subject and the driving of the nature of profit, as well as the legislative defects and the imperfection of law enforcement, the labor dispatch has been deformed in our country, a large number of illegal or illegal labor dispatch by law. At this stage, at the present stage, the key period of building a socialist legal system and the transformation of the economic structure at the time of increasing the strength of our country to build a socialist legal system and the transformation of the economic structure is put forward by the party in the third Plenary Session of the 18th CPC Central Committee: "adhere to the direction of the socialist market economy reform, in order to promote social fairness and justice and promote the well-being of the people as a starting point." On the theme of "governing the country by law" in the fourth Plenary Session of the 18th CPC Central Committee, the party's overall goal of building a "rule of law China" was clarified. As an important department law in the socialist legal system, the labor law was used to safeguard the legitimate rights and interests of the workers, to balance the socialistic labor relations and even to maintain the social classes. The harmonious and stable relationship has a very important role. Therefore, the perfection of the labor law is an important part of the perfection of the socialist legal system. However, the legal system of labor dispatch in the labor law is not perfect. In practice, the legal system of labor dispatch is evaded and the improper labor dispatch is carried out so as to infringe the labor union. The phenomenon of legal rights and interests happens. How to improve its legal regulation and avoid its social harm is a problem that the theoretical and practical circles must pay attention to. This paper tries to take this as the starting point to make a thorough analysis and Research on the perfection of the legal regulation of inappropriate labor dispatch in our country, and put forward the relevant perfect plan.
The main body of this paper is divided into four parts. The first part is the analysis of the basic theory of labor dispatch. This part mainly analyzes the characteristics of labor dispatch and its development status at home and abroad, and combs the theories and theories about the legal relations of labor dispatch at home and abroad. The second part is the form of the improper labor dispatch and the form of the expression of the improper labor dispatch. Its social harm. This part points out the forms of improper labor dispatch, including public dispatch, collusion dispatch, anonymous dispatch and self dispatch, and analyzes the social harm caused by improper labor dispatch, including the construction of harmonious labor relations, which is not conducive to the harmonious stability of society, and is contrary to the realization of fair and justice. Third On the basis of the second part, it puts forward the existing problems in the legal regulation of improper labor dispatch, which is manifested in the defects and loopholes in the legislation, including the legal relations between the labor unit and the laborers, and the regulations of the labor dispatch enterprises' access and operation, and the stipulations on the equal treatment between the dispatched workers and the formal workers. The fourth part is the perfect proposal for the legal regulation of improper labor dispatch. The principle of perfecting the legal regulation of improper labor dispatch is the principle of protecting the legitimate rights and interests of the workers and the principle of fairness in the distribution of responsibility. The principle of balancing the interests of the parties. In the value orientation of the perfect mechanism of the improper Labor Dispatch Legal Regulation, it should be inclined to protect the interests of the labourers as the disadvantaged group, and make clear the way to take the responsibility of the improper labor dispatch employers. On this basis, the concept of labor employment according to law should be strengthened by improving the relevant legislation and strengthening the function of labor. The law enforcement efforts of the Department and the protection measures of trade unions and trade associations are used to improve the legal regulation of inappropriate labor dispatch in our country, thus making our labor dispatch play a positive role in economic construction, and promote the protection of the basic rights of workers, and then realize the fair and justice of the society.
