【摘要】:本文選取的研究切入點(diǎn)是企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的推動(dòng)機(jī)制分析,主要關(guān)注的是企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的推動(dòng)對(duì)于中國勞動(dòng)關(guān)系幾個(gè)方面可能產(chǎn)生的影響,在此基礎(chǔ)上,提出對(duì)于源自西方發(fā)達(dá)國家的企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的應(yīng)對(duì)之策。 文章主體共分三部分。 第一部分從企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)出現(xiàn)的背景入手,重點(diǎn)解析了企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的推動(dòng)機(jī)制,并在此基礎(chǔ)上對(duì)企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的本質(zhì)和特性進(jìn)行了概括和分析。 本文從企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的歷史和現(xiàn)實(shí)背景入手,介紹了其出現(xiàn)的必然性,試圖做出一個(gè)簡(jiǎn)單的推動(dòng)機(jī)制模型,并對(duì)模型中各種推動(dòng)力量發(fā)揮的作用和作用方式進(jìn)行了分析。 基于這些分析,本文認(rèn)為,目前的企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)的本質(zhì)是主要由消費(fèi)者運(yùn)動(dòng)沿著國際商品鏈逆向推動(dòng)的,企業(yè)與股東外的利益相關(guān)者關(guān)系發(fā)展對(duì)于企業(yè)利益實(shí)現(xiàn)方式的重構(gòu)。 文章第二部分重點(diǎn)討論了中國企業(yè)承擔(dān)社會(huì)責(zé)任的歷史、企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)在中國的現(xiàn)狀,以及企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)發(fā)展對(duì)中國勞動(dòng)關(guān)系幾個(gè)方面產(chǎn)生的以及可能產(chǎn)生的影響。 企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)第一次將企業(yè)的盈利能力與企業(yè)對(duì)于員工權(quán)益的保護(hù)內(nèi)在地結(jié)合起來。與勞動(dòng)法外在的強(qiáng)制相比,這種內(nèi)在的結(jié)合必將促使企業(yè)經(jīng)營者和管理者改變思維習(xí)慣,將保護(hù)員工權(quán)益的行為上升為一種自覺行動(dòng)。 理論上來說,不存在企業(yè)社會(huì)責(zé)任規(guī)范對(duì)于中國勞動(dòng)標(biāo)準(zhǔn)體系的沖擊和破壞。但是畢竟我國與西方發(fā)達(dá)國家的勞工標(biāo)準(zhǔn)以及國際勞工組織的核心勞工標(biāo)準(zhǔn)存在著差異,中國生產(chǎn)企業(yè)在對(duì)西方跨國公司要求的企業(yè)社會(huì)責(zé)任規(guī)范的執(zhí)行,就必然對(duì)我國的勞工標(biāo)準(zhǔn)體系和勞工權(quán)益保護(hù)產(chǎn)生影響。 在勞動(dòng)權(quán)利標(biāo)準(zhǔn)方面,企業(yè)社會(huì)責(zé)任運(yùn)動(dòng)在中國的發(fā)展將有利于中國勞工自由結(jié)社權(quán)和集體談判權(quán)的實(shí)現(xiàn),也有利于勞工集體行動(dòng)權(quán)作為一種維權(quán)方式得到認(rèn)可。在勞動(dòng)條件標(biāo)準(zhǔn)方面,各種企業(yè)社會(huì)責(zé)任規(guī)范一般都把勞動(dòng)收入和
[Abstract]:The starting point of this paper is the analysis of the driving mechanism of the CSR movement. The main concern is the influence of the CSR movement on the labor relations in China. The main body of this paper is divided into three parts. The first part starts with the background of CSR movement, and analyzes the promotion mechanism of CSR movement. On this basis, the essence and characteristics of CSR movement are summarized and analyzed. This paper begins with the historical and realistic background of CSR movement, and introduces the inevitability of its emergence. This paper attempts to make a simple model of driving mechanism, and analyzes the role and mode of various forces in the model. Based on these analyses, this paper holds that, The essence of the current CSR movement is mainly driven by the consumer movement in reverse direction along the international commodity chain. The second part focuses on the history of corporate social responsibility in China and the current situation of CSR movement in China. For the first time, the CSR movement combines the profitability of enterprises with the protection of employees' rights and interests. Compared with the external compulsion of labor law, this kind of internal combination will urge managers and managers to change their thinking habits and turn the behavior of protecting employees' rights and interests into a kind of conscious action. There is no impact and destruction of CSR on Chinese labor standard system. But after all, there are differences between the labor standards of our country and the western developed countries and the core labor standards of the International Labour Organization. Chinese production enterprises are enforcing the norms of corporate social responsibility required by western transnational corporations.
