【摘要】：大學(xué)生在校外從事兼職工作已然遍及社會各個角落,校外兼職大部分是學(xué)生的自覺性行為,目前處于放任無序的狀況。隨著兼職大學(xué)生隊伍的不斷壯大,出現(xiàn)了許多損害大學(xué)生權(quán)益的現(xiàn)象,主要表現(xiàn)為無故延長工時、克扣薪資等。多數(shù)大學(xué)生表示權(quán)益受損后維權(quán)困難,只能自認(rèn)倒霉。究其原因,是學(xué)校未將大學(xué)生校外兼職納入教育管理范圍內(nèi),政府管理部門監(jiān)管不嚴(yán),大學(xué)生自身法律意識淡薄等。但最重要的原因是理論界和實務(wù)界對大學(xué)生的身份認(rèn)定未形成共鳴,法律法規(guī)也并未對相關(guān)概念和法律關(guān)系做出具體界定,這種大學(xué)生私自在校外打工行為目前正處于一個“三不管”的境地。文章闡述了大學(xué)生在校外私自打工過程中面臨的各種侵害行為,透過現(xiàn)象看本質(zhì),深刻討論了造成此種現(xiàn)象的具體成因,提出現(xiàn)行的首要任務(wù)是明確界定大學(xué)生校外兼職的理論概念,同時理清與用人單位的法律關(guān)系性質(zhì),明確提出對大學(xué)生兼職行為應(yīng)分開討論,不可統(tǒng)一而論。逐步完善法律法規(guī),規(guī)范各個社會主體的法律責(zé)任,積極調(diào)動高校、用人單位、社會的力量共同保障大學(xué)生的合法權(quán)益,鼓勵大學(xué)生加強自我防范意識,協(xié)調(diào)好兼職與學(xué)習(xí)的關(guān)系,運用法律的手段進行維權(quán)。
[Abstract]:College students engaged in part-time work outside the school has spread all over the society, the majority of part-time outside the school is the conscious behavior of students, at present in a state of laissez-faire disorder. With the development of part-time college students, there are many phenomena that damage the rights and interests of college students, such as prolonging working hours for no reason, withholding wages and so on. Most college students said that rights and interests after the rights and interests of the difficulties, can only admit bad luck. The reason is that the university does not bring the part-time work of college students into the scope of education management, the government administration department is not strict, the university students' own legal consciousness is weak and so on. However, the most important reason is that the theoretical and practical circles have not resonated with the identification of college students, and the relevant concepts and legal relations have not been specifically defined by laws and regulations. This kind of college student private work outside school behavior is currently in a "three regardless" situation. This paper expounds all kinds of encroachment behaviors that college students are facing in the process of off-campus self-employment, and discusses the causes of the phenomenon through the essence of the phenomenon. The first task is to clearly define the theoretical concept of university students' part-time work outside school, at the same time to clarify the nature of the legal relationship with employers, and clearly put forward that the part-time activities of college students should be discussed separately, which cannot be unified. Gradually improve laws and regulations, standardize the legal responsibilities of various social subjects, actively mobilize the forces of universities, employers, and society to jointly protect the legitimate rights and interests of college students, and encourage college students to strengthen their sense of self-prevention. Coordinate the relationship between part-time and study, use legal means to protect rights.
