【摘要】：就一起急性職業(yè)性硫化氫中毒引起的行政處罰案作了初步分析 ,認(rèn)為在開始調(diào)查取證時(shí) ,就分清責(zé)任主體和責(zé)任人是本案實(shí)施行政處罰的關(guān)鍵 ;同時(shí)對(duì)行政處罰過(guò)程中違法主體的確定、從輕處罰及有關(guān)責(zé)任人員的處罰等法律問(wèn)題進(jìn)行了探討。
[Abstract]:This paper makes a preliminary analysis on an administrative punishment case caused by acute occupational hydrogen sulfide poisoning, and thinks that the key to the administrative punishment in this case is to distinguish the responsible subject from the responsible person when the investigation is started. At the same time, the determination of the subject of violation in the course of administrative punishment, the punishment of lighter punishment and the punishment of the responsible personnel are discussed.
