【摘要】: 國際貿(mào)易與勞工權(quán)益保護相聯(lián)系的問題是一個十分復(fù)雜的問題,它涉及到國際國內(nèi)、經(jīng)濟社會、政治各個方面,在世界各國經(jīng)濟社會差異較大的形式下,關(guān)于國際貿(mào)易中勞工權(quán)益保護水平問題的解決,將是一個長期的博奕的過程,各國基于自身利益的考慮必然會采取各不相同的立場,但在這個長期的過程中,國際貿(mào)易中的勞工權(quán)益保護水平在每一個階段必然會呈現(xiàn)出適應(yīng)該階段的特點。在今后的時間,國際貿(mào)易與勞工權(quán)益的關(guān)系問題將繼續(xù)受到各個國家、區(qū)域性國際組織以及全球性組織的關(guān)注。中國已全面進入了國際主流社會,市場的全面開放必然導(dǎo)致資本、信息、勞動力的全球流動,它要求我們的法律制度要與國際條約、國際慣例接軌。這就凸顯出勞動法在一些方面的規(guī)范己經(jīng)不能適應(yīng)社會發(fā)展的要求,特別是加入WTO帶來的與國際勞工權(quán)益保護的接軌和銜接問題,因此,參照國際勞動立法建立健全我國勞動標準體系是一項重大而急迫的任務(wù)。 本文共分為四章。第一章以“國際勞工標準”入手,分析了“國際核心勞工標準”這一全文的核心概念的涵義;第二章首先通過對勞工權(quán)益保護這一概念的闡述,分析了當今國際勞工權(quán)益保護水平與國際貿(mào)易間的關(guān)系,指出了兩者并不是簡單的促進或者阻礙的關(guān)系,而是在經(jīng)濟社會的大環(huán)境下相互作用、相互影響;其次闡述了當今國際社會對國際貿(mào)易中勞工權(quán)益保護的立法和實踐,從發(fā)達國家的國內(nèi)立法、國際雙邊和區(qū)域貿(mào)易協(xié)定、非政府組織有關(guān)勞工保護的各種標準認證和國際組織中有關(guān)勞工權(quán)益保護的文件幾個方面進行陳述;最后,對國際社會對勞工權(quán)益保護水平的未來發(fā)展趨勢進行了預(yù)測;第三章重點分析了當前我國勞工權(quán)益保護水平與國際勞工標準的差距所在,我國的勞工法律規(guī)制的現(xiàn)狀表現(xiàn)出立法和國際勞工標準的差距以及勞工執(zhí)法過程中執(zhí)法上的漏洞和不足之處;第四章從我國實際情況出發(fā),通過借鑒上一章分析的結(jié)果--查找出差距所在,從而提出了我國應(yīng)采取的對策,分為法律的規(guī)制以及其他方面措施的實施,從而使我國的勞工權(quán)益保護法律規(guī)制更好的與國際貿(mào)易的需要和國際勞工標準的要求相接軌。
[Abstract]:The connection between international trade and the protection of labor rights and interests is a very complex problem. It involves all aspects of international and domestic, economic and social, and political, and in the form of greater economic and social differences among countries in the world. The solution to the problem of the level of labor rights and interests protection in international trade will be a long-term game process. Countries will inevitably take different positions on the basis of their own interests, but in this long-term process, The level of protection of labor rights and interests in international trade is bound to adapt to this stage in each stage. In the future, the relationship between international trade and labor rights and interests will continue to be of concern to countries, regional international organizations and global organizations. China has entered the international mainstream society in an all-round way, and the overall opening of the market will inevitably lead to the global mobility of capital, information and labor force. It requires our legal system to be in line with international treaties and international practices. This highlights the fact that some aspects of labor law norms have been unable to meet the requirements of social development, especially the problems of convergence and convergence with the protection of international labour rights and interests brought about by China's entry into the WTO. It is an important and urgent task to establish and perfect China's labor standard system with reference to international labor legislation. This paper is divided into four chapters. The first chapter begins with "International Labor Standards" and analyzes the meaning of the core concept of "International Core Labor Standards". This paper analyzes the relationship between the level of international labor rights and interests protection and international trade, and points out that the relationship between them is not a simple promotion or hindrance, but interaction and interaction in the economic and social environment. Secondly, it expounds the legislation and practice of the international community to protect the labor rights and interests in international trade, from the domestic legislation of developed countries, the international bilateral and regional trade agreements, Several aspects of NGO certification on labor protection standards and documents on labour rights protection in international organizations are presented. Finally, the future development trend of the level of labour rights protection in the international community is forecasted. The third chapter focuses on the analysis of the gap between the current level of protection of labor rights and interests in China and international labour standards. The current situation of labor law regulation in China shows the gap between legislation and international labor standards, as well as the loopholes and deficiencies in the enforcement of labor law. Chapter four starts from the actual situation of our country. By using the results of the previous chapter to find out the gap, this paper puts forward the countermeasures that should be taken in our country, including the legal regulation and the implementation of other measures. Thus, the legal regulation of labor rights and interests protection in our country is better in line with the needs of international trade and the requirements of international labor standards.
