【摘要】：海上人身傷亡損害是海上運(yùn)輸業(yè)經(jīng)常面對的問題之一,如何對海上人身傷亡 損害進(jìn)行賠償也是當(dāng)前學(xué)術(shù)界較多爭議的問題。正確處理此類案件,對于保持海 上運(yùn)輸業(yè)的健康發(fā)展具有重要意義。本文從海上人身傷亡損害賠償范圍、由此產(chǎn) 生的精神損害賠償,以及責(zé)任限制等幾方面作以探討,以期根據(jù)我國的國情,盡 可能地找到一個海上運(yùn)輸企業(yè)和受害者利益的平衡點(diǎn),為進(jìn)一步完善海上人身傷 亡損害賠償?shù)挠嘘P(guān)法律提供依據(jù)。
[Abstract]:Personal injury and injury at sea is one of the problems often faced by the maritime transportation industry. Compensation for damages is also a controversial issue in academic circles. Correct handling of such cases for maintaining the sea The healthy development of the transportation industry is of great significance. In this paper, the scope of compensation for personal injury and injury at sea is discussed. The compensation for mental damage and the limitation of liability are discussed in this paper, which is expected to be based on the national conditions of our country.
