【摘要】：婦女權(quán)利的特殊保護(hù)法律制度一直以來都是社會(huì)各界十分關(guān)注的問題,國內(nèi)外法學(xué)界都越來越多的致力于完善各國的相關(guān)立法,從而保護(hù)婦女的權(quán)利。近幾十年來,隨著我國各項(xiàng)立法的完善,我國對(duì)婦女權(quán)利的特殊保護(hù)的法律制度已經(jīng)取得了較為顯著的結(jié)果。但是,由于我國的歷史制度、長期以來的社會(huì)環(huán)境、對(duì)婦女權(quán)利保護(hù)的相關(guān)立法起步較晚等原因,我國對(duì)婦女權(quán)利的特殊保護(hù)的法律制度還存在著一些不足。因此,本文以我國憲法及各部門法對(duì)婦女權(quán)利保護(hù)的法律規(guī)定為基礎(chǔ),通過介紹西方及我國對(duì)婦女權(quán)利保護(hù)的歷史及發(fā)展,針對(duì)我國目前立法對(duì)婦女權(quán)利保護(hù)的不足,提出了使婦女權(quán)利特殊保護(hù)的法律制度更加完善的立法建議。全文除了引言和結(jié)語外分為五個(gè)部分： 第一部分介紹了婦女權(quán)利的概說,通過回顧西方婦女權(quán)利的由來、變化及我國婦女權(quán)利的傳承和發(fā)展,讓大家對(duì)婦女權(quán)利的歷史有初步的了解。 第二部分闡述了我國憲法對(duì)婦女權(quán)利保護(hù)的規(guī)定,通過對(duì)憲法的變遷、對(duì)現(xiàn)行憲法的解讀、對(duì)現(xiàn)行憲法對(duì)婦女權(quán)利保護(hù)的價(jià)值缺位的剖析,較為詳細(xì)的解讀我國憲法對(duì)婦女權(quán)利的保護(hù)規(guī)定。 第三部分系統(tǒng)分析了現(xiàn)有的各個(gè)部門法對(duì)婦女權(quán)利的規(guī)定,通過詳細(xì)評(píng)析《婦女權(quán)益保障法》、《婚姻法》、《勞動(dòng)法》,梳理了我國法條中對(duì)婦女權(quán)利的保護(hù)的法律規(guī)定,看到了我國立法對(duì)婦女權(quán)利保護(hù)的努力及成就。 第四部分是以聯(lián)合國和其他有代表性國家為例,對(duì)國外立法對(duì)婦女權(quán)利的保護(hù)進(jìn)行考察。同時(shí),將國外對(duì)婦女權(quán)利的立法保護(hù)的經(jīng)驗(yàn)進(jìn)行本土化分析,探索我國立法對(duì)婦女權(quán)利保護(hù)的可行性措施。 第五部分是我國對(duì)婦女權(quán)利特殊保護(hù)之部門法構(gòu)建,提出了對(duì)《婦女權(quán)益保障法》、《婚姻法》、《勞動(dòng)法》的補(bǔ)充及修改意見,希望通過法律的完善,使我國能更好、更全面的保護(hù)婦女的合法權(quán)利,使婦女這一弱勢(shì)群體更好的受到法律的保護(hù),獲得真正公平、公正的社會(huì)地位,從而更好地踐行我國的社會(huì)主義法治理念。
[Abstract]:The legal system of special protection of women's rights has always been a matter of great concern to all walks of life. More and more legal circles at home and abroad are devoted to perfecting the relevant legislation of various countries to protect the rights of women. In recent decades, with the perfection of various legislation in our country, the legal system of special protection of women's rights has obtained remarkable results. However, due to the historical system of our country, the social environment for a long time and the late start of the relevant legislation on the protection of women's rights, there are still some deficiencies in the legal system for the special protection of women's rights in our country. Therefore, based on the protection of women's rights in China's constitution and various laws, this paper introduces the history and development of the protection of women's rights in the west and China, and aims at the insufficiency of the protection of women's rights in the current legislation of our country. Some legislative suggestions are put forward to improve the legal system for the special protection of women's rights. In addition to the introduction and conclusion, the full text is divided into five parts: The first part introduces the general introduction of women's rights. By reviewing the origin, changes and the inheritance and development of women's rights in China, we have a preliminary understanding of the history of women's rights. The second part expounds the provisions of the protection of women's rights in the Constitution of our country, through the changes of the Constitution, the interpretation of the current Constitution, the analysis of the value of the protection of women's rights in the current Constitution. A more detailed interpretation of the protection of women's rights in the Constitution of China's provisions. The third part systematically analyzes the provisions of the existing laws on women's rights, through a detailed analysis of the "Women's Rights and interests Protection Law", "Marriage Law", "Labor Law", combing the legal provisions of the protection of women's rights in the articles of our country. Saw our country legislation to the women's rights protection effort and the achievement. The fourth part takes the United Nations and other representative countries as examples to investigate the protection of women's rights by foreign legislation. At the same time, this paper analyzes the experiences of foreign countries in the protection of women's rights, and explores the feasible measures for the protection of women's rights in our legislation. The fifth part is the construction of the department law of special protection of women's rights in our country, and puts forward some suggestions to supplement and amend the Law on the Protection of Women's Rights and interests, the Marriage Law and the Labor Law, hoping to make our country better through the perfection of the law. More comprehensive protection of women's legal rights, so that this vulnerable group of women better protected by the law, to obtain a real fair and just social status, so as to better practice our socialist concept of the rule of law.
