勞動(dòng)法上待命時(shí)間的法律問(wèn)題研究

【摘要】:勞動(dòng)法上,因待命時(shí)間引發(fā)的勞動(dòng)糾紛在全國(guó)出現(xiàn)了“井噴”的現(xiàn)狀,但由于立法層面法律的缺失,地方立法各不相同,造成法院在認(rèn)定待命時(shí)間是否為工作時(shí)間時(shí)作出各種不同的判斷,這既損害勞動(dòng)者的合法權(quán)益,減損司法權(quán)威,也折射出相關(guān)理論研究的滯后。在借鑒有關(guān)待命時(shí)間定性的學(xué)理基礎(chǔ)上,對(duì)工作時(shí)間問(wèn)題重新做了一次研究,并結(jié)合法院在司法案件中的對(duì)待命時(shí)間問(wèn)題具體情況的認(rèn)定及判決,最終得出待命時(shí)間符合工作時(shí)間要求,應(yīng)當(dāng)定性為工作時(shí)間的結(jié)論。在具體的待命時(shí)間認(rèn)定過(guò)程中,將實(shí)際案件中常見(jiàn)的待命時(shí)間具體展開(kāi)為監(jiān)視性待命時(shí)間、侯傳性待命時(shí)間、附隨性待命時(shí)間這三種類(lèi)型進(jìn)行討論。通過(guò)具體案例的整理和分析,嘗試探討出各類(lèi)待命時(shí)間可行的工資支付方式和法律規(guī)制方法。囿于司法實(shí)務(wù)中各種待命時(shí)間的勞動(dòng)者受控程度不同,因而有關(guān)工作時(shí)間歸屬的標(biāo)準(zhǔn)和判斷依據(jù)也不能一概而論。故本文根據(jù)每一種待命時(shí)間的不同特點(diǎn),仔細(xì)剖析其勞動(dòng)法理的精神,并結(jié)合司法判例,對(duì)每一類(lèi)待命時(shí)間的認(rèn)定問(wèn)題分別提出自己的初步思路。
[Abstract]:In the labor law, labor disputes caused by standby time have appeared the status quo of "blowout" in the whole country. However, due to the lack of laws at the legislative level, local legislation is different. As a result, the court makes all kinds of different judgments when determining whether the standby time is working time, which not only damages the legitimate rights and interests of workers, detracts from judicial authority, but also reflects the lag of relevant theoretical research. On the basis of reference to the doctrine of the qualitative nature of standby time, a new study has been made on the question of working time, and combined with the determination and judgement of the court's treatment of the question of life time in judicial cases, Finally, the conclusion that standby time meets the working time requirement should be defined as working time. In the process of identifying the specific standby time, the common standby time in actual cases is divided into three types: surveillance standby time, transmit standby time and accompanying standby time. Through the analysis of specific cases, this paper tries to explore the feasible wage payment methods and legal regulation methods of all kinds of standby time. Due to the different degree of control of all kinds of standby time in judicial practice, the standard and judgment basis of working time attribution can not be generalized either. Therefore, according to the different characteristics of each kind of standby time, this paper carefully analyzes the spirit of its labor law, and combining with judicial precedent, puts forward its own preliminary thinking on the determination of each kind of standby time.
