【摘要】:法律所提供的制度框架改變、強(qiáng)化市場主體的利益結(jié)構(gòu),并以此改變、指引人們的行為。《勞動(dòng)合同法》改變了用人單位的成本收益結(jié)構(gòu),有利于該法的實(shí)施。但勞動(dòng)合同的性質(zhì)決定其強(qiáng)烈依賴于國家提供的第三方保護(hù),因此完善勞動(dòng)爭議解決機(jī)制以降低勞動(dòng)者尋求救濟(jì)的交易成本是貫徹落實(shí)《勞動(dòng)合同法》的關(guān)鍵。
[Abstract]:The institutional framework provided by the law changes, strengthens the interest structure of the market subject, and guides people's behavior. The Labor contract Law has changed the structure of cost and income of the employer, which is beneficial to the implementation of the law. However, the nature of labor contract strongly depends on the third party protection provided by the state. Therefore, it is the key to carry out the Labor contract Law to perfect the labor dispute settlement mechanism to reduce the transaction cost of workers seeking relief.
