船員法定權(quán)利與合同權(quán)利的法律問題研究

【摘要】:航海是一個(gè)特殊的行業(yè),船員是一個(gè)特殊的群體,船員的利益需要特殊的保障。但我國目前的船員勞動(dòng)立法還很不完善,船員的利益難以保障。為此,本文試圖從法理的角度來分析船員的法定權(quán)利的實(shí)現(xiàn),并從這一點(diǎn)出發(fā),探討了我國船員合同權(quán)利的保障問題。 本文首先分析了船員的利益需要特殊的保障的原因。船上勞動(dòng)生活環(huán)境與陸地上的巨大差異,這種差異導(dǎo)致了船員在勞動(dòng)報(bào)酬、勞動(dòng)條件、損害補(bǔ)償?shù)确矫嬗兄约禾厥獾囊,引出了船員利益的特殊性和特殊利益的特殊保護(hù)。接著,本文從法理意義上對(duì)權(quán)利的分類和他們的關(guān)系進(jìn)行了論述,并具體分析船員的情況,得到船員勞務(wù)合同是船員法定權(quán)利轉(zhuǎn)化為船員實(shí)有權(quán)利的重要載體這一結(jié)論。既然有了上述結(jié)論,便不難發(fā)現(xiàn),解決好船員勞務(wù)合同問題,將船員勞務(wù)合同法制化,規(guī)范化,對(duì)保障船員合同權(quán)利有重要作用;因此本文對(duì)船員勞務(wù)合同的性質(zhì),訂立程序,和具體內(nèi)容,,參考國外先進(jìn)立法經(jīng)驗(yàn),并通過結(jié)合我國的情況,做了大量論述。外派船員是我國的特殊船員群體,一般來說并不受我國的船員勞動(dòng)立法調(diào)整,但由于國內(nèi)現(xiàn)有的勞務(wù)輸出體制可能影響到這部分船員的利益,因此在本文中也做出了分析,并給出了解決問題的建議。最后,筆者將文中結(jié)合我國實(shí)際情況作出的論述具體化,做出了關(guān)于船員勞務(wù)合同方面的立法建議,希望能對(duì)建立我國完善的船員立法體系有一定的幫助。
[Abstract]:Navigation is a special trade, crew is a special group, the interests of crew need special protection. However, China's current legislation of crew labor is still very imperfect, the interests of the crew is difficult to protect. Therefore, this paper attempts to analyze the realization of the legal rights of crew members from the angle of legal theory, and from this point of view, discusses the protection of the contractual rights of crew members in China. This paper first analyzes the reasons why the crew interests need special protection. There is a great difference between the working and living environment of the ship and the land, which leads to the special demands of the crew in the aspects of labor compensation, working conditions, damage compensation and so on, which leads to the particularity of the interests of the crew and the special protection of the special interests. Then, this paper discusses the classification of rights and their relationship from the legal point of view, and analyzes the situation of crew members in detail, and draws the conclusion that the seafarers' labor contract is an important carrier of the legal rights of crew members to the actual rights of crew members. Since we have reached the above conclusion, it is not difficult to find that it is not difficult to solve the problem of the crew labor contract, to legalize and standardize the crew labor contract, which plays an important role in the protection of the crew contract rights; therefore, this paper concludes the procedure for the nature of the crew labor contract. Referring to the foreign advanced legislative experience and combining the situation of our country, this paper makes a lot of exposition. The expatriate crew is a special group of crew members in our country. Generally speaking, it is not adjusted by our country's crew labor legislation. However, because the existing labor export system in China may affect the interests of this part of the crew, it is also analyzed in this paper. Some suggestions are given to solve the problem. Finally, the author concretely discusses the actual situation of our country, and makes some legislative suggestions on the crew labor contract, hoping to be helpful to the establishment of the perfect seamen legislation system in our country.
