學(xué)生實(shí)習(xí)期間因工受傷法律問題研究

【摘要】:隨著我國教育體制的不斷革新,高校大程度的擴(kuò)招使每年畢業(yè)生人數(shù)較上年都有所增加,帶來的好處是讓更多的學(xué)生接受到了高等教育,但隨之而來的就業(yè)的壓力也會(huì)增加,因此也就產(chǎn)生了規(guī)模龐大的實(shí)習(xí)學(xué)生群體。通過實(shí)習(xí),學(xué)生既可以積累實(shí)踐經(jīng)驗(yàn),又可以豐富社會(huì)閱歷,為真正適應(yīng)社會(huì)生活做準(zhǔn)備,在競爭愈發(fā)白熱化的勞動(dòng)力市場中脫穎而出。傳統(tǒng)意義上的實(shí)習(xí)是指教學(xué)實(shí)習(xí),屬于學(xué)校教學(xué)培養(yǎng)計(jì)劃的一部分,是學(xué)生把在書本上學(xué)到的理論知識(shí)應(yīng)用于實(shí)踐的一種實(shí)習(xí)方式。近年來,實(shí)習(xí)也衍生出了其他類型,不再僅僅是教學(xué)實(shí)習(xí)這一種類型,而是涌現(xiàn)出了諸如帶薪實(shí)習(xí)、頂崗實(shí)習(xí)、就業(yè)實(shí)習(xí)等多種形式。勞動(dòng)不可避免的伴隨著風(fēng)險(xiǎn),尤其是一些高危工作,學(xué)生在實(shí)習(xí)期間因工受傷的情況屢見不鮮,而實(shí)習(xí)生因工受傷后可否認(rèn)定為工傷的關(guān)鍵是對其身份屬性的認(rèn)定。實(shí)習(xí)學(xué)生的法律身份依照實(shí)習(xí)類型的不一樣而有所區(qū)別,其與實(shí)習(xí)單位之間是否真正建立起了勞動(dòng)關(guān)系也要依照實(shí)習(xí)類型的不一樣而具體分析?墒,我國現(xiàn)行的法律法規(guī)尚未對勞動(dòng)者的含義下清楚的定義,對實(shí)習(xí)學(xué)生的法律身份也沒作詳細(xì)說明,這造成了實(shí)習(xí)學(xué)生法律身份屬性不明的尷尬局面,導(dǎo)致就其是否具有勞動(dòng)者資格這個(gè)爭議性的問題眾說紛紜,其與單位間的法律關(guān)系性質(zhì)也不好確定,因而可否對因工受傷的實(shí)習(xí)學(xué)生進(jìn)行工傷事故認(rèn)定存在廣泛的爭議。司法實(shí)踐中多數(shù)情況下是將實(shí)習(xí)學(xué)生認(rèn)定為學(xué)生,而非勞動(dòng)者,將其排除在《勞動(dòng)法》的保護(hù)之外,因工受傷的解決途徑一般只能是訴諸于民法。本文旨從《勞動(dòng)法》意義上的"勞動(dòng)者"角度出發(fā),通過對相關(guān)法律條文的理解分析,探討實(shí)習(xí)學(xué)生的法律身份及其與單位間的法律關(guān)系性質(zhì),以確定學(xué)生實(shí)習(xí)期間因工受傷后法律保障的依據(jù),并借鑒其他發(fā)達(dá)國家的成功經(jīng)驗(yàn),提出保障我國實(shí)習(xí)學(xué)生因工受傷法律體系的完善構(gòu)想。本文一共分為四個(gè)部分:第一部分在對學(xué)生實(shí)習(xí)期間因工受傷相關(guān)法律問題作出清楚解析的基礎(chǔ)上,深入探討了實(shí)習(xí)學(xué)生的法律身份屬性及其與相關(guān)主體的法律關(guān)系。第二部分首先是對學(xué)生在實(shí)習(xí)期間因工受傷事故認(rèn)定現(xiàn)狀進(jìn)行分析,繼而找出造成其因工受傷認(rèn)定困境的成因,然后歸納總結(jié)了實(shí)習(xí)學(xué)生因工受傷后的現(xiàn)有救濟(jì)模式。第三部分主要是介紹域外關(guān)于學(xué)生在實(shí)習(xí)期間因工受傷的相關(guān)規(guī)定,以及值得我國參考借鑒的法律政策規(guī)定。第四部分是關(guān)于提出我國實(shí)習(xí)學(xué)生因工受傷保障體系的完善構(gòu)想,包括法律精神、完善立法和具體措施三個(gè)方面。
[Abstract]:With the continuous reform of our country's educational system, the large increase in enrollment in colleges and universities has increased the number of graduates each year compared with the previous year. The benefit is that more students will receive higher education, but the pressure of employment will also increase. As a result, there is a large group of intern students. Through practice, students can not only accumulate practical experience, but also enrich social experience, prepare for the real adaptation to social life, and stand out in the increasingly competitive labor market. The traditional practice refers to the teaching practice, which is a part of the school teaching training plan. It is a practical way for students to apply the theoretical knowledge they have learned in books to practice. In recent years, the practice has also derived other types, not just the teaching practice, but has emerged a variety of forms such as paid internship, job placement practice, employment practice and so on. Labor inevitably accompanied by risks, especially some high-risk work, students in practice because of the situation of injury is common, and the intern can be identified as work injuries after the key is to identify their identity attributes. The legal status of the intern students is different according to the type of practice, and it should be analyzed concretely whether or not the labor relationship has been established between the intern units and the practice units. However, the current laws and regulations of our country have not yet clearly defined the meaning of the laborer, and the legal status of the intern students has not been explained in detail, which has caused the awkward situation that the legal identity of the intern students is not clear. As a result, there are different opinions on whether or not they have the qualification of laborer, and the nature of the legal relationship between them and the unit is also difficult to determine, so whether the injured students can be recognized as a work-related injury has a wide range of controversy. In the judicial practice, most of the practice students are regarded as students, not laborers, and they are excluded from the protection of Labor Law. The only way to solve injuries caused by work is to resort to civil law. From the angle of "laborer" in the sense of "labor law", this article aims to discuss the legal status of intern students and the nature of the legal relationship between them and their units through the understanding and analysis of the relevant legal provisions. In order to determine the basis of the legal protection after the students' work injury during the practice period, and to draw lessons from the successful experiences of other developed countries, the author puts forward the idea of perfecting the legal system to protect the students' injuries caused by work in our country. This paper is divided into four parts: the first part makes a clear analysis of the legal problems related to injuries caused by work during the practice of students, and probes into the legal identity of the students and their legal relationship with the relevant subjects. The second part is to analyze the status quo of students' identification of work-related injuries during practice, and then to find out the causes of the difficulties caused by work-related injuries, and then summed up the existing relief mode after the students' work-related injuries. The third part mainly introduces the relevant regulations about the students' injuries during the practice period, and the legal and policy provisions that our country can use for reference. The fourth part is about putting forward the idea of perfecting the security system of the injured students at work in our country, including three aspects: the spirit of law, the perfection of legislation and the concrete measures.
