【摘要】:外國(guó)人在華非法就業(yè)問(wèn)題與外國(guó)人非法入境、非法居留并稱“三非”問(wèn)題,它已經(jīng)發(fā)展成我國(guó)目前一個(gè)十分突出的社會(huì)管理問(wèn)題。而導(dǎo)致外國(guó)人非法就業(yè)問(wèn)題的根本原因除了我國(guó)經(jīng)濟(jì)飛速發(fā)展帶來(lái)了較多就業(yè)機(jī)會(huì)之外,更主要的還是我國(guó)針對(duì)外國(guó)人就業(yè)的法律規(guī)制體系存在問(wèn)題。為了從制度層面解決外國(guó)人非法就業(yè)問(wèn)題,加強(qiáng)對(duì)外國(guó)人非法就業(yè)進(jìn)行法律規(guī)制問(wèn)題的研究就有著現(xiàn)實(shí)必要性與緊迫性。目前,世界各國(guó)普遍建立了較為完善的外國(guó)人就業(yè)管理法律制度對(duì)國(guó)內(nèi)外國(guó)勞工就業(yè)進(jìn)行規(guī)范。作為非移民國(guó)家,我國(guó)現(xiàn)行外國(guó)人就業(yè)管理制度體系并不完善,僅僅對(duì)國(guó)際勞工中具有專業(yè)技術(shù)外國(guó)人員的勞動(dòng)就業(yè)進(jìn)行規(guī)范,即便中國(guó)式“綠卡”制度也采取有條件地實(shí)行從國(guó)際勞工向永久居留資格轉(zhuǎn)變的方式。外國(guó)人就業(yè)管理制度理應(yīng)與移民取向相并行,但現(xiàn)行管理制度并不符合我國(guó)發(fā)展現(xiàn)狀,對(duì)外國(guó)人就業(yè)管理制度進(jìn)行完善勢(shì)在必行。 本篇論文主要分為四個(gè)部分。第一章論述了外國(guó)人就業(yè)管理的基本概念和理論,指出外國(guó)人非法就業(yè)是指沒有取得定居權(quán)的外國(guó)人在中國(guó)境內(nèi)依法從事社會(huì)勞動(dòng)并獲取勞動(dòng)報(bào)酬的行為。另外本章對(duì)外國(guó)人在華就業(yè)與非法移民的聯(lián)系與區(qū)別、非法就業(yè)的危害進(jìn)行闡述,并結(jié)合我國(guó)國(guó)情分析外國(guó)人非法就業(yè)的成因,指出進(jìn)一步規(guī)范和完善我國(guó)外國(guó)人就業(yè)管理制度的必要性和緊迫性;第二章對(duì)外國(guó)人就業(yè)的法律規(guī)制的現(xiàn)狀進(jìn)行了介紹,包括外國(guó)人在華就業(yè)的基本法律及相關(guān)的規(guī)章制度,同時(shí)對(duì)于針對(duì)外國(guó)人就業(yè)管理的職能部門和具體職責(zé)進(jìn)行了具體的介紹,明確我國(guó)外國(guó)人就業(yè)管理制度的基本構(gòu)架;第三章介紹了我國(guó)現(xiàn)行的外國(guó)人就業(yè)管理制度所存在的問(wèn)題,分別從立法內(nèi)容、執(zhí)法水平、司法救濟(jì)等幾個(gè)方面展開論述,為下文針對(duì)性地提出解決方案做理論鋪墊,,第四章是完善我國(guó)出入境管理制度的行政法對(duì)策與建議,分別從立法、執(zhí)法、司法等幾個(gè)方面結(jié)合我國(guó)當(dāng)前的現(xiàn)實(shí)國(guó)情和已經(jīng)取得外國(guó)人就業(yè)管理制度經(jīng)驗(yàn),為我國(guó)確立制度準(zhǔn)則提供參考,繼而在立法措施、運(yùn)行機(jī)制、調(diào)控手段等方面對(duì)就業(yè)管理制度予以完善。
[Abstract]:The problem of illegal employment of foreigners in China and the illegal entry and residence of foreigners in China, which has developed into a very prominent social management problem in China. In addition to the rapid development of our economy, the main reason for the problem of illegal employment of foreigners is that there are problems in the legal regulation system of employment of foreigners in our country. In order to solve the problem of illegal employment of foreigners from the system level, it is necessary and urgent to strengthen the research on the legal regulation of illegal employment of foreigners. At present, the countries all over the world have established relatively perfect foreign employment management legal system to regulate the domestic and foreign labor employment. As a non-immigrant country, the current employment management system of foreigners in China is not perfect, and it only regulates the employment of foreign workers with professional skills in the international labor force. Even the Chinese green card system adopts a conditional shift from international labor to permanent residency. The employment management system of foreigners should be parallel with the orientation of immigrants, but the current management system does not accord with the present situation of our country, so it is imperative to perfect the management system of employment for foreigners. This paper is divided into four parts. The first chapter discusses the basic concept and theory of foreigners' employment management, and points out that illegal employment of foreigners refers to the behavior of foreigners who have not obtained the right to settle in China to engage in social work and get paid for their work according to law. In addition, this chapter expounds the relations and differences between the employment of foreigners in China and illegal immigrants, the harm of illegal employment, and analyzes the causes of illegal employment of foreigners in the light of the national conditions of our country. The author points out that it is necessary and urgent to further standardize and perfect the employment management system of foreigners in China. Chapter two introduces the current situation of the legal regulation on the employment of foreigners, including the basic laws and relevant rules and regulations on the employment of foreigners in China. At the same time, it introduces the functional departments and specific responsibilities of the employment management of foreigners, and clarifies the basic framework of the employment management system of foreigners in China. The third chapter introduces the existing problems of the foreign employment management system in China, respectively from the legislative content, the level of law enforcement, judicial relief and other aspects of the discussion, for the following targeted solutions to do theoretical foreshadowing, The fourth chapter is the administrative law countermeasures and suggestions to perfect our country's entry and exit management system, which combines the current situation of our country and the experience of foreigners' employment management system from the aspects of legislation, law enforcement, judicature and so on. It provides the reference for establishing the system standard of our country, then consummates the employment management system in the legislative measure, the operation mechanism, the control method and so on.
