我國集體合同主體的法律問題研究

【摘要】: 集體合同制度是市場經(jīng)濟國家用以調整勞動關系而普遍實行的一種勞動法律制度。通過集體談判和集體合同制度的推行,可以及時充分地反映勞動者的意見和要求,把自發(fā)的、無序的沖變?yōu)橛行虻囊婪▍f(xié)商和協(xié)調,保證勞動關系的和諧穩(wěn)定運行,有效維護勞動者的合法權益。從集體合同的起源及在西方的歷史演變過程中,我們可以看出集體合同制度在社會生活中的重要作用。 集體合同制度在我國已有一段時期的發(fā)展,但在我國的實施狀況卻不盡人意,即便是集體合同主體問題這樣的基本理論,在學術界甚至是在一些教科書中,其闡述都存在相當嚴重的問題。這與集體合同本身的一些規(guī)定、我國工會制度以及政府作用的發(fā)揮等相關因素有關。 本文試圖通過明確集體合同的談判主體,分析我國集體合同制度的現(xiàn)狀及立法缺失并吸收借鑒西方國家集體合同制度相關立法經(jīng)驗和教訓等幾個方面來完善集體合同制度,以達到有效保障勞動者權益的目的。
[Abstract]:Collective contract system is a kind of labor law system which is widely practiced in market economy countries to adjust labor relations. Through collective bargaining and the implementation of the collective contract system, workers' opinions and demands can be fully reflected in a timely manner, and the spontaneous and disorderly impact can be transformed into orderly consultation and coordination according to law, so as to ensure the harmonious and stable operation of labor relations. To effectively safeguard the legitimate rights and interests of workers. From the origin of collective contract and its historical evolution in the West, we can see that the system of collective contract plays an important role in social life. The system of collective contract has been developed for a period of time in our country, but its implementation in our country is not satisfactory. Even the basic theory of the subject of collective contract is in academic circles and even in some textbooks. There are quite serious problems in their exposition. This is related to the provisions of the collective contract itself, the trade union system and the role of the government. This paper attempts to perfect the collective contract system by clarifying the bargaining subject of collective contract, analyzing the present situation and legislative deficiency of collective contract system in our country and absorbing and drawing lessons from the relevant legislative experience and lessons of the collective contract system in western countries. In order to achieve the purpose of effective protection of workers' rights and interests.
