殘疾人就業(yè)權(quán)的法律保障研究

【摘要】:殘疾人作為一個(gè)特殊群體,其在社會(huì)的運(yùn)行與中始終處于弱勢(shì)地位。而這一群體在生存與發(fā)展方面,也面臨著嚴(yán)峻的困難,他們的生活常因?yàn)樯眢w原因受到諸多限制,遭到社會(huì)的歧視,他們的合法權(quán)利也無法得到有效的實(shí)現(xiàn),這一點(diǎn)在就業(yè)領(lǐng)域表現(xiàn)得尤為明顯。他們受到自身心理或生理?xiàng)l件的限制,在就業(yè)市場(chǎng)中的權(quán)利無法得到實(shí)現(xiàn),侵犯殘疾人就業(yè)權(quán)利的現(xiàn)象不一而足。 就業(yè),是每一個(gè)個(gè)人維系生活的重要手段。我國憲法規(guī)定,每個(gè)公民都享有就業(yè)的權(quán)利。殘疾人具有公民主體地位,也應(yīng)當(dāng)享有就業(yè)權(quán)利。因此,對(duì)殘疾人就業(yè)權(quán)的保護(hù),是每一個(gè)社會(huì)、政府不可推卸的責(zé)任。可以說,切實(shí)保護(hù)殘疾人的就業(yè)權(quán)利,是提高殘疾人社會(huì)地位,確保其生存發(fā)展的基礎(chǔ)。只有殘疾人的就業(yè)權(quán)得到了確認(rèn)與保護(hù),才能更有效地將殘疾人參與到社會(huì)生活之中,共享社會(huì)發(fā)展的成果,進(jìn)而促進(jìn)殘疾人其他權(quán)利能夠有效實(shí)現(xiàn)。 我國現(xiàn)有各類殘疾人總數(shù)8300多萬,占總?cè)丝诘?.24%,涉及2.6億個(gè)家庭。如此龐大的殘疾人群體,決定了需要對(duì)殘疾人就業(yè)權(quán)的保護(hù)建立一個(gè)完善的殘疾人保障法律體系,以保障和促進(jìn)殘疾人就業(yè)的實(shí)現(xiàn)。這對(duì)保護(hù)殘疾人的人權(quán),全面實(shí)現(xiàn)我國和諧社會(huì)的發(fā)展有著十分重要的意義。殘疾人作為社會(huì)的中的一員,雖然身體或心理上受到限制,但他們?nèi)耘f享有實(shí)現(xiàn)自身價(jià)值、參與社會(huì)活動(dòng)的愿望和權(quán)利,他們希望得到社會(huì)的廣泛認(rèn)同,獲得與正常人同等的尊嚴(yán)。而對(duì)殘疾人就業(yè)權(quán)給予保護(hù),讓殘疾人能通過合法勞動(dòng)的方式實(shí)現(xiàn)自身價(jià)值,正是他們實(shí)現(xiàn)利益訴求的前提條件。 本文主要利用比較的方法,通過對(duì)如何保護(hù)殘疾人就業(yè)權(quán)問題進(jìn)行探討。首先,介紹殘疾人就業(yè)權(quán)保護(hù)的歷史發(fā)展,對(duì)殘疾人就業(yè)權(quán)的基本內(nèi)容進(jìn)行闡述,分析殘疾人就業(yè)權(quán)的特殊性質(zhì)以及說明研究殘疾人就業(yè)權(quán)的必要性。其次,列舉了域外有關(guān)殘疾人就業(yè)權(quán)的立法,分析他國的立法經(jīng)驗(yàn),探討域外法律對(duì)我國殘疾人就業(yè)權(quán)保障方面值得借鑒之處。再次,對(duì)我國殘疾人就業(yè)權(quán)的現(xiàn)狀與問題進(jìn)行分析。最后,從我國的法律制度入手,,提出保障我國殘疾人就業(yè)權(quán)的構(gòu)想,為保護(hù)殘疾人合法權(quán)益提供對(duì)策。
[Abstract]:The disabled, as a special group, are always in a weak position in the society. This group also faces severe difficulties in terms of survival and development. Their lives are often restricted by many physical reasons, discriminated against by society, and their legal rights cannot be effectively realized. This is particularly evident in the employment sector. They are restricted by their own psychological or physiological conditions, their rights in the job market can not be realized, and the phenomenon of violation of the employment rights of the disabled is numerous. Employment is an important means for every individual to maintain his or her life. Our constitution stipulates that every citizen has the right to employment. Disabled persons have the status of civil subject and should also enjoy the right to employment. Therefore, the protection of disabled employment right is every society, the government can not shirk the responsibility. It can be said that the protection of the employment rights of the disabled is the basis for improving their social status and ensuring their survival and development. Only when the employment right of the disabled is recognized and protected, can the disabled participate in the social life more effectively, share the fruits of social development, and then promote the effective realization of other rights of the disabled. The total number of disabled people in China is over 83 million, accounting for 7.24 million of the total population and involving 260 million families. Such a large group of persons with disabilities decides that it is necessary to establish a perfect legal system for the protection of disabled persons' right to employment in order to guarantee and promote the realization of employment of persons with disabilities. It is of great significance to protect the human rights of the disabled and realize the development of harmonious society in our country. Persons with disabilities, as members of society, although physically or psychologically restricted, still enjoy the desire and right to realize their own values and participate in social activities, and they wish to be widely recognized by society, Get the same dignity as normal people. The protection of disabled persons' right to employment and the realization of their own value through legal labor is the precondition for them to realize their interests. This article mainly uses the comparison method, through how to protect the disabled person's employment right question carries on the discussion. Firstly, it introduces the historical development of the protection of the disabled's right to employment, expounds the basic contents of the right to employment of the disabled, analyzes the special nature of the right to employment of the disabled and explains the necessity of studying the employment right of the disabled. Secondly, it enumerates the legislation on the employment right of the disabled outside China, analyzes the legislative experience of other countries, and probes into the aspects of the protection of the employment right of the disabled in our country. Thirdly, the present situation and problems of employment right of disabled people in China are analyzed. Finally, starting from the legal system of our country, the author puts forward the idea of protecting the disabled persons' right to employment in order to provide countermeasures for protecting the legal rights and interests of the disabled.
