勞動爭議解決機制實證研究

【摘要】:本文在介紹勞動爭議概念基礎(chǔ)上,以北京市某區(qū)、某特大型國有企業(yè)勞動爭議調(diào)解、仲裁和訴訟實際工作為基礎(chǔ),通過對勞動爭議案件調(diào)查研究,歸納提出目前勞動爭議的現(xiàn)狀;通過對勞動爭議解決機制的研究,分析勞動爭議解決機制弊端,提出了完善和改進勞動爭議解決機制建議和措施。除結(jié)尾和致謝外,本文共分六章進行論述。 第一章緒論。主要論述了課題研究背景、研究目的和意義、主要研究方法。 第二章勞動爭議概述。分三個部分進行論述,一是論述勞動爭議概念,二是論述勞動爭議構(gòu)成要件,三是論述勞動爭議主要特征。 第三章勞動爭議的基本情況。在這部分,以北京市某區(qū)勞動爭議案件為樣本,通過對勞動爭議調(diào)解、仲裁和訴訟案件調(diào)查分析,歸納提出目前勞動爭議基本情況:勞動爭議案件數(shù)量大幅度增長、勞動爭議案件在2009年出現(xiàn)了拐點、京外農(nóng)村戶籍勞動者成為維權(quán)的主要群體、勞動爭議中勞動者主體青壯年比例大、勞動爭議中勞動者主體男性比例高于女性、集體勞動爭議案件數(shù)量和涉案人員增幅大、勞動報酬成為勞動爭議的焦點、勞動者申請仲裁比例大弱勢地位明顯、用人單位法律意識逐步增強、勞動者主張權(quán)利存在盲目性、用人單位侵犯勞動者合法權(quán)益問題仍然比較突出11個方面的特點。 第四章勞動爭議處理制度概述。在這部分,論述了“一調(diào)一裁兩審”勞動爭議處理制度及構(gòu)成要素,介紹了勞動爭議協(xié)商、勞動爭議調(diào)解、勞動爭議仲裁和勞動爭議訴訟主要內(nèi)容和特點。 第五章現(xiàn)行勞動爭議處理制度的缺陷。在這部分,對“一調(diào)一裁兩審”、“仲裁前置”勞動爭議處理制度的弊端和缺陷進行了分析,提出勞動爭議協(xié)商可操作性差,企業(yè)勞動爭議調(diào)解公信力不夠等勞動爭議協(xié)商調(diào)解制度弊端;“仲裁前置程序”浪費仲裁和司法資源,“仲裁前置程序”降低了仲裁的權(quán)威性,“仲裁前置程序”程序復雜、審理周期長等勞動爭議仲裁制度弊端;訴訟制度的滯后,法官的非專業(yè)化等勞動爭議訴訟制度弊端。 第六章完善勞動爭議處理機制的建議。本章論述了完善勞動爭議解決機制應遵循的基本原則,提出了建立完善企業(yè)勞動爭議協(xié)商解決機制,建立完善政府、企業(yè)和社會勞動爭議調(diào)解機制,完善勞動爭議仲裁機制,完善勞動爭議訴訟制度等建議和措施。
[Abstract]:On the basis of introducing the concept of labor dispute, based on the actual work of labor dispute mediation, arbitration and litigation in a certain district of Beijing, a large state-owned enterprise, this paper investigates and studies labor dispute cases.This paper summarizes the present situation of labor dispute, analyzes the disadvantages of labor dispute settlement mechanism, and puts forward some suggestions and measures to perfect and improve the labor dispute settlement mechanism.In addition to the end and thanks, this article is divided into six chapters.The first chapter is introduction.This paper mainly discusses the research background, research purpose and significance, main research methods.The second chapter is an overview of labor disputes.It is divided into three parts: one is to discuss the concept of labor dispute, the other is to discuss the elements of labor dispute, and the third is to discuss the main characteristics of labor dispute.Chapter III the basic situation of labor disputes.In this part, taking the labor dispute cases in a certain district of Beijing as a sample, through the investigation and analysis of labor dispute mediation, arbitration and litigation cases, the author concludes that the current basic situation of labor dispute is: the number of labor dispute cases has increased by a large margin.Labor dispute cases appeared inflection point in 2009, rural household registration workers outside Beijing became the main group of rights protection, the proportion of workers in labor disputes was large, the proportion of male workers in labor disputes was higher than that of women.The number of collective labor dispute cases and the personnel involved increase greatly, the labor compensation becomes the focus of the labor dispute, the proportion of workers applying for arbitration is large and weak, the legal consciousness of the employing unit is gradually strengthened, and the workers claim their rights blindly.Unit of choose and employ persons infringing laborer legitimate rights and interests problem still relatively outstanding 11 respects characteristic.Chapter IV Overview of labor dispute settlement system.In this part, the author discusses the system and elements of labor dispute settlement, and introduces the main contents and characteristics of labor dispute negotiation, labor dispute mediation, labor dispute arbitration and labor dispute litigation.Chapter V the defects of the current labor dispute settlement system.In this part, the disadvantages and defects of the labor dispute handling system of "one adjustment, one cut and two trials" and "arbitration leading" are analyzed, and the poor operability of labor dispute negotiation is put forward.Enterprises' labor dispute mediation lacks credibility and other defects of labor dispute negotiation mediation system, "arbitration front procedure" wastes arbitration and judicial resources, "arbitration front procedure" reduces the authority of arbitration, and "arbitration front procedure" is complicated.The drawback of labor dispute arbitration system is long trial period, the lag of litigation system and the malpractice of judge's non-specialization.The sixth chapter is about the suggestion of perfecting the mechanism of labor dispute settlement.This chapter discusses the basic principles that should be followed in perfecting the labor dispute settlement mechanism, and puts forward the establishment and improvement of the enterprise labor dispute negotiation and settlement mechanism, the establishment and perfection of the government, enterprise and social labor dispute mediation mechanism, and the perfection of the labor dispute arbitration mechanism.Improve labor dispute litigation system and other suggestions and measures.
