【摘要】：正 在日本,特別是在第二次世界大戰(zhàn)剛結(jié)束后的混亂時(shí)期,從1945年至1980年間,勞使糾紛頻發(fā),其中絕大多數(shù)訴至各城市法院,因此推動了勞動法學(xué)的長足進(jìn)展�，F(xiàn)在關(guān)于勞動問題的法律解釋,勞動法學(xué)者的通說及判例已基本確立。在那以前,學(xué)說也好、判例也好,還沒有充分確立,這也是原因之一,解決勞使間尖銳對立的方策也難以尋覓,由于長期的勞動爭議,使得企業(yè)破產(chǎn),經(jīng)營者妻離子散,其中也不乏自殺者。 一方面,工會內(nèi)部會員由于思想、信條(例如:自由主義、社會主義、共產(chǎn)主義等)及對雇傭者斗爭方針未必一致,會員間產(chǎn)生毫不妥協(xié)的對立,多數(shù)會員退會,組成新工會(所謂第二工會),由于上述對立的激化,基于多數(shù)決定原則的工會運(yùn)營
[Abstract]:It was in Japan, especially in the chaotic period immediately after the end of the second World War, that between 1945 and 1980, labour disputes were frequent, the vast majority of which went to the city courts. This has pushed forward the great progress of the labor law. Now the legal interpretation of the labor problem, the general explanation and the precedents of the labor law scholars have been basically established. Before that, the doctrine or the precedent has not been fully established, which is also one of the reasons. It is also difficult to find a solution to the sharp opposition between labor workers. As a result of long-term labor disputes, the enterprises go bankrupt and the managers leave their wives and children. Among them, there are many suicides. On the one hand, the members of the trade union are due to their ideas. The tenets (such as liberalism, socialism, communism, etc.) and the policies of the struggle against employers are not necessarily the same, there is an uncompromising confrontation among members, and most members withdraw from the council. The formation of a new trade union (the so-called second trade union), the operation of a trade union based on the principle of majority decision as a result of the intensification of the above opposition
