【摘要】：在社會主義市場經(jīng)濟(jì)體制下,用人單位經(jīng)營自主權(quán)不斷擴(kuò)大,用人單位作為獨(dú)立的市場經(jīng)濟(jì)主體享有充分的人事管理自主權(quán),制定用人單位內(nèi)部規(guī)章制度,調(diào)整用人單位內(nèi)部勞動關(guān)系,是用人單位行使經(jīng)營管理自主權(quán)的一個重要方面,也是加強(qiáng)用人單位內(nèi)部勞動管理的客觀需要。隨著我國經(jīng)濟(jì)體制改革的逐步深入,用人單位內(nèi)部的勞動關(guān)系日趨多樣化、利益化和復(fù)雜化,用人單位如何建立一種和諧的勞動關(guān)系,如何建立規(guī)章制度和勞動合同的有效銜接和效力適用準(zhǔn)則,如何看待違紀(jì)解除中的程序性問題等等,都迫切需要在立法上給予明確化。
[Abstract]:Under the socialist market economy system, the employers' operating autonomy is constantly expanding. As an independent market economy subject, the employing units enjoy full personnel management autonomy and formulate the internal rules and regulations of the employing units. Adjusting the internal labor relations of the employing units is an important aspect for the employers to exercise their autonomy in operation and management, and is also an objective need to strengthen the internal labor management of the employing units. With the gradual deepening of the reform of the economic system in our country, The labor relations within the employing units are becoming more and more diversified, beneficial and complicated. How to establish a harmonious labor relationship, how to establish the effective connection between the rules and regulations and the labor contracts and the applicable criteria for the effectiveness of the labor contracts, How to treat the procedural problems in the process of disobeying discipline and so on, it is urgent to make it clear in legislation.
