山西省大學(xué)生就業(yè)調(diào)控法律問(wèn)題研究

【摘要】: 目前,高校畢業(yè)生的就業(yè)問(wèn)題日益成為全社會(huì)關(guān)注的焦點(diǎn),并且成為我國(guó)當(dāng)前經(jīng)濟(jì)社會(huì)發(fā)展中的嚴(yán)峻挑戰(zhàn)和突出問(wèn)題,這種狀況持續(xù)下去將會(huì)嚴(yán)重妨礙整個(gè)社會(huì)的和諧發(fā)展。究其原因,就業(yè)市場(chǎng)機(jī)制不完善,一些體制性障礙的存在,是造成我國(guó)教育體制轉(zhuǎn)軌過(guò)程中大學(xué)生就業(yè)難的重要因素。如何發(fā)揮政府宏觀調(diào)控的主導(dǎo)作用,完善就業(yè)市場(chǎng),運(yùn)用政策和法律手段掃除體制性障礙,以政策引導(dǎo)大學(xué)生就業(yè),整體推進(jìn)大學(xué)生充分就業(yè),進(jìn)而實(shí)現(xiàn)整個(gè)社會(huì)的和諧發(fā)展,還需要進(jìn)行不斷的研究和探索,并具有重要的理論和現(xiàn)實(shí)意義。 本文以山西省當(dāng)前高校畢業(yè)生的就業(yè)現(xiàn)狀為立足點(diǎn),分析了導(dǎo)致大學(xué)畢業(yè)生就業(yè)難的因素,以宏觀調(diào)控法為核心,綜合運(yùn)用法理學(xué)、憲法學(xué)、勞動(dòng)法學(xué)及經(jīng)濟(jì)學(xué)、社會(huì)學(xué)等學(xué)科原理和學(xué)者的研究成果,對(duì)大學(xué)生就業(yè)問(wèn)題加以研究,結(jié)合山西省的省情,闡述了宏觀調(diào)控法調(diào)整大學(xué)生就業(yè)問(wèn)題的必要性,以期促進(jìn)山西省大學(xué)畢業(yè)生的就業(yè)工作順利進(jìn)行。全文分四個(gè)部分。 第一部分,大學(xué)生就業(yè)與宏觀調(diào)控的基本理論。本文從大學(xué)生就業(yè)的基本內(nèi)涵入手,結(jié)合宏觀調(diào)控法理論的就業(yè)調(diào)控內(nèi)容,進(jìn)一步分析大學(xué)生就業(yè)與宏觀調(diào)控理論的相互關(guān)系,得出大學(xué)生就業(yè)只有在國(guó)家進(jìn)行宏觀調(diào)控的情況下才能得以解決。 第二部分,山西省促進(jìn)大學(xué)生就業(yè)的宏觀調(diào)控政策及法律調(diào)整。在本部分,分析了山西省近幾年的就業(yè)現(xiàn)狀與存在的問(wèn)題,以及山西省促進(jìn)大學(xué)生就業(yè)的政策和法律,提出現(xiàn)有的安置大學(xué)生就業(yè)政策具有臨時(shí)性和不穩(wěn)定性,并指出促進(jìn)大學(xué)生就業(yè)專門性政策與法律調(diào)控體系的建立,是解決大學(xué)生就業(yè)的根本措施。 第三部分,國(guó)內(nèi)外促進(jìn)大學(xué)生就業(yè)的宏觀調(diào)控政策及法律調(diào)整。筆者首先對(duì)我國(guó)促進(jìn)大學(xué)生就業(yè)的宏觀調(diào)控政策及法律進(jìn)行了分析。然后對(duì)美國(guó)、日本和英國(guó)三個(gè)國(guó)家的大學(xué)生就業(yè)調(diào)控政策分別進(jìn)行了闡述與比較研究。借鑒國(guó)外大學(xué)生就業(yè)促進(jìn)政策,對(duì)比分析我國(guó)市場(chǎng)經(jīng)濟(jì)過(guò)程中解決大學(xué)生就業(yè)所存在的問(wèn)題和對(duì)策,更有助于理論和政策的科學(xué)性與有效性。 第四部分,在前三部分的基礎(chǔ)上,筆者認(rèn)為,加快山西省中小企業(yè)的發(fā)展,重點(diǎn)扶持知識(shí)與科技含量高的產(chǎn)業(yè),增加企業(yè)勞動(dòng)力容納量;加強(qiáng)山西省重點(diǎn)高校、重點(diǎn)學(xué)科專業(yè)的建設(shè),提高學(xué)生質(zhì)量和綜合素質(zhì);加強(qiáng)大學(xué)生就業(yè)地方立法,加快大學(xué)畢業(yè)生就業(yè)市場(chǎng)的地方法規(guī)建設(shè),成立平等就業(yè)監(jiān)督咨詢機(jī)構(gòu),加強(qiáng)內(nèi)部和外部監(jiān)督,完善宏觀調(diào)控體系,為山西省大學(xué)生就業(yè)提供長(zhǎng)效、穩(wěn)定的制度保障。
[Abstract]:At present, the employment of college graduates has increasingly become the focus of attention of the whole society, and has become a severe challenge and prominent problem in the current economic and social development of our country. The continuation of this situation will seriously hinder the harmonious development of the whole society. The reason is that the mechanism of the job market is not perfect and some institutional obstacles exist. It is an important factor that causes the college students' employment difficulty in the course of the transition of our country's educational system. How to give play to the leading role of the government's macro-control, perfect the job market, use the policy and legal means to remove the system obstacle, and guide the university student's employment by the policy. In order to promote the college students to obtain full employment and realize the harmonious development of the whole society, it is necessary to study and explore continuously and have important theoretical and practical significance. Based on the present employment situation of college graduates in Shanxi Province, this paper analyzes the factors that lead to the difficulty of obtaining employment for college graduates, taking the macro-control law as the core, and comprehensively applying jurisprudence, constitutional law, labor law and economics. Based on the principles of sociology and the research results of scholars, this paper studies the employment problem of college students, and expounds the necessity of adjusting the employment problem of college students by macro-control law in combination with the provincial situation in Shanxi Province. In order to promote the employment of university graduates in Shanxi Province smoothly. The full text is divided into four parts. The first part is the basic theory of college students' employment and macro-control. By further analyzing the relationship between the employment of college students and the theory of macro-control, it is concluded that the employment of college students can be solved only when the state carries out macro-control. The second part, the macro-control policy and legal adjustment of promoting college students' employment in Shanxi Province. In this part, it analyzes the present employment situation and existing problems of Shanxi Province in recent years, as well as the policies and laws of promoting the employment of college students in Shanxi Province. It is pointed out that the existing employment policy for college students is temporary and unstable, and it is pointed out that the establishment of special employment policy and legal regulation system is the fundamental measure to solve the employment of college students. In the third part, the author analyzes the macro-control policies and laws to promote the employment of college students at home and abroad. This paper expounds and compares the employment regulation and control policies of college students in Japan and the United Kingdom, and compares and analyzes the problems and countermeasures of solving the employment of college students in the process of market economy in our country by referring to the employment promotion policies of foreign university students. It is more helpful to the science and validity of theory and policy. The fourth part, on the basis of the first three parts, the author believes that to accelerate the development of small and medium-sized enterprises in Shanxi Province, to focus on supporting industries with high knowledge and science and technology content, to increase the capacity of enterprise labor force, to strengthen the key colleges and universities in Shanxi Province, To improve the quality and comprehensive quality of students in the construction of key disciplines and specialties, to strengthen local legislation on employment for college students, to speed up the construction of local laws and regulations on the employment market for college graduates, to set up advisory bodies for equal employment supervision, and to strengthen internal and external supervision. Improve the macro-control system to provide a long-term and stable institutional guarantee for the employment of college students in Shanxi Province.
