【摘要】:對公司與其高級管理人員來說,他們之間所建立的關(guān)系是否是勞動 關(guān)系,是否適用勞動法來調(diào)整,在合同訂立中如何調(diào)整與規(guī)范,即為本 文擬探討的課題。文章首先論證了對實踐中有爭議的公司高級管理人員 是否是勞動者的問題并作了肯定的結(jié)論,同時對此類勞動合同的特征做 了闡述。然后,文章從公司高級管理人員勞動合同的特征入手,在訂立 程序、合同內(nèi)容、法律效力等方面做了分析。作者認(rèn)為此類合同應(yīng)當(dāng)引 入締約過失責(zé)任制度,并作了相應(yīng)的論述。最后,作者前瞻了勞動法勞 動合同的發(fā)展,指出公司高級管理人員勞動合同研究的普遍意義;并建 議在勞動法合同訂立條款的修改中,引入要約承諾、締約過失責(zé)任、合 同的可撤銷等制度。

Then , the article starts with the characteristics of the company ' s senior management employee ' s labor contract , where it is concluded
The author thinks such a contract should be cited as the analysis of the procedure , the content of the contract , the legal effect and so on .
In the end , the author looked forward to the labor law .
The development of dynamic contract indicates the general significance of the research of labor contract of senior managers in the company ;
