【摘要】：檢視近年來中國的勞動法律,已經(jīng)不是有無法律而是需要什么樣的法律的問題。問題所在是,國家規(guī)制下社會權(quán)利和社會合作顯現(xiàn)缺失,工人們甚至用犧牲乃至生命呼喚社會權(quán)利和社會合作。回望近代以來的中國勞動法制歷史,國家規(guī)制下社會權(quán)利和社會合作的缺失乃是一種長久之痛。環(huán)顧世界勞動法制的演進,勞動法律在中國有效實施的基本條件,便是補救社會權(quán)利和社會合作的缺失,國家規(guī)制則需要與之相互協(xié)調(diào)。
[Abstract]:To examine China's labor laws in recent years, the question is not whether there is any law but what kind of law is needed. The problem lies in the absence of social rights and social cooperation under state regulation. Workers even use their lives to call for social rights and social cooperation. Looking back at the history of China's labor legal system since modern times, The absence of social rights and social cooperation under state regulation is a lasting pain. Looking at the evolution of the world labor law system and the basic conditions for the effective implementation of labor law in China, it is necessary to remedy the lack of social rights and social cooperation. State regulation needs to be coordinated with each other.
