【摘要】: 兩性就業(yè)機(jī)會不均等、競爭不公平是當(dāng)前女性就業(yè)求職過程中遇到的最主要問題。女大學(xué)生就業(yè)難已成為當(dāng)今社會的焦點問題。根據(jù)調(diào)查表明,大學(xué)女生的綜合素質(zhì)并不差于男生,然而,在參與人才市場競爭時,很多用人單位卻只愿意選擇男性大學(xué)生,并在招聘啟事上公然聲稱只要男性。此外,女性在就業(yè)市場遭受的不公平待遇還體現(xiàn)在收入、升遷和職業(yè)培訓(xùn)等方面。雖然現(xiàn)實就業(yè)過程中存在如此多的性別歧視現(xiàn)象,女性受害者卻難以尋求到充分的法律救濟(jì)途徑。這就體現(xiàn)出我國現(xiàn)行保護(hù)女性平等就業(yè)權(quán)的法律制度存在著不容忽視的缺陷。因此,如何認(rèn)識女性在就業(yè)中所面臨的性別歧視?如何通過相應(yīng)的立法措施來防止不平等現(xiàn)象的擴(kuò)大?這些都是值得人們深思的問題。 平等權(quán)是公民享有的一項基本權(quán)利。文章以女性平等就業(yè)權(quán)的立法保護(hù)為研究對象,從女性平等就業(yè)權(quán)的內(nèi)涵入手,首先介紹了國內(nèi)外有關(guān)反對就業(yè)性別歧視法律制度的立法概況,通過分析目前我國女性就業(yè)的現(xiàn)狀,對就業(yè)過程中女性遭受性別歧視的原因進(jìn)行了剖析,最后結(jié)合我國目前的立法狀況,提出當(dāng)前女性平等就業(yè)權(quán)立法保護(hù)的原則,并對立法環(huán)節(jié)中的技術(shù)性難題進(jìn)行了探討,以期構(gòu)建較為完善的女性平等就業(yè)權(quán)立法保護(hù)框架。
[Abstract]:Unequal employment opportunities and unfair competition between the two sexes are the most important problems in the process of women seeking employment. The employment difficulties of female college students have become the focus of the society. According to the survey, The overall quality of college girls is not inferior to that of men. However, when they compete in the job market, many employers are willing to choose only male college students and openly claim that they only want men in their job advertisements. Unfair treatment of women in the job market is also reflected in income, promotion and vocational training. Although there are so many sexist phenomena in the actual employment process, However, it is difficult for female victims to seek adequate legal remedies. This shows that the current legal system of protecting women's equal right to employment has defects that can not be ignored. Therefore, how to understand the gender discrimination that women face in employment? How to prevent the widening of inequality through corresponding legislative measures? These are all questions worth pondering over. The right to equality is a basic right enjoyed by citizens. This article takes the legislative protection of women's equal employment right as the object of study, starting with the connotation of women's equal employment right. First of all, it introduces the domestic and foreign legislation on the legal system against gender discrimination in employment, analyzes the current situation of female employment in our country, and analyzes the reasons why women suffer from gender discrimination in the process of employment. Finally, combined with the current legislative situation of our country, this paper puts forward the principles of the legislative protection of women's equal employment right, and probes into the technical problems in the legislative links in order to construct a more perfect legislative protection framework for women's equal employment rights.
