【摘要】：在法經(jīng)濟(jì)學(xué)看來,當(dāng)前中國貧困問題的產(chǎn)生根源主要體現(xiàn)為反貧困法律制度供給不均衡和法律程序制定的壟斷收益。基于此,中國反貧困法律制度的有效供給應(yīng)以憲法中有關(guān)公民基本權(quán)利的規(guī)定為依據(jù),以物權(quán)法為基礎(chǔ),以經(jīng)濟(jì)法、社會保障法、勞動法以及自然資源與環(huán)境保護(hù)法等社會法為主要內(nèi)容,由專門性反貧困立法和相關(guān)性制度建設(shè)共生形成的制度系統(tǒng)。
[Abstract]:From the point of view of law and economics, the root causes of the current poverty problem in China are mainly reflected in the imbalance in the supply of the anti-poverty legal system and the monopoly benefits in the legal process. The effective supply of China's anti-poverty legal system should be based on the provisions of the Constitution concerning the basic rights of citizens, on the basis of the property law, on the economic law and on the social security law. Labor law and social laws such as natural resources and environment protection are the main contents, which are formed by specialized anti-poverty legislation and related system.
