【摘要】：隨著社會主義市場經(jīng)濟的發(fā)展，，我國勞動關(guān)系已經(jīng)從個別勞動關(guān)系階段發(fā)展到集體勞動關(guān)系階段，對集體勞動關(guān)系進行調(diào)整已成為一個突出的研究課題。集體協(xié)商制度是通過勞動者組織與用人單位或其組織相互協(xié)商來調(diào)整集體勞動關(guān)系的制度，被認為是使勞資沖突規(guī)范化的一項偉大的“社會發(fā)明”，并被實踐證明是市場經(jīng)濟體制下協(xié)調(diào)勞資矛盾、促成勞動關(guān)系和諧最為有效的機制之一�！吨腥A人民共和國勞動合同法》的頒布與實施，使我國個別勞動關(guān)系得到了很好的調(diào)整和規(guī)范。關(guān)注集體勞動關(guān)系的調(diào)整，關(guān)注調(diào)整集體勞動關(guān)系的核心制度——集體協(xié)商制度，將是我國勞動立法發(fā)展的方向。 本文首先是厘清集體協(xié)商制度的相關(guān)概念，對集體協(xié)商制度的理論基礎(chǔ)進行闡述，在此基礎(chǔ)上分析推行集體協(xié)商制度的必要性。論文的第二部分選擇具有代表性的國外集體協(xié)商制度進行介紹，從中獲得完善我國集體協(xié)商制度的啟示。最后，本文對我國集體協(xié)商制度的現(xiàn)狀、存在問題以及完善對策進行了詳實的論述。
[Abstract]:With the development of the socialist market economy, labor relations in our country have developed from the stage of individual labor relations to the stage of collective labor relations. The adjustment of collective labor relations has become an outstanding research topic. The collective bargaining system is a system that adjusts collective labor relations through mutual consultation between workers' organizations and employers or their organizations. It is considered to be a great "social invention" to standardize the labor and capital conflicts, and has been proved to be the coordination of labor and capital conflicts under the market economy system. The promulgation and implementation of the Labor contract Law of the people's Republic of China has made individual labor relations in China well adjusted and regulated. It will be the direction of the development of labor legislation in our country to pay attention to the core system of adjusting collective labor relations-collective negotiation system. The first part of this paper is to clarify the relevant concepts of the collective consultation system, and to elaborate the theoretical basis of the collective consultation system. On this basis, the necessity of carrying out collective consultation system is analyzed. In the second part of the paper, the representative foreign collective consultation system is introduced, from which the enlightenment of perfecting the collective consultation system in China is obtained. This paper discusses the present situation, existing problems and perfect countermeasures of collective consultation system in China.
