【摘要】：權(quán)利救濟(jì)是衡量法治實(shí)施體系是否健全的重要標(biāo)準(zhǔn)。構(gòu)造平等就業(yè)權(quán)司法救濟(jì)體系,是貫徹落實(shí)依法治國要求加強(qiáng)人權(quán)司法保障的重要體現(xiàn)。構(gòu)造平等就業(yè)權(quán)司法救濟(jì)體系,應(yīng)當(dāng)發(fā)揮立法的統(tǒng)率和引領(lǐng)作用,通過立法全面構(gòu)建包括建立健全違憲審查制度與憲法訴訟機(jī)制、完善勞動(dòng)爭(zhēng)議處理機(jī)制、補(bǔ)強(qiáng)三大訴訟機(jī)制、發(fā)展公益訴訟等司法救濟(jì)體系;構(gòu)造平等就業(yè)權(quán)司法救濟(jì)體系還應(yīng)當(dāng)強(qiáng)化法律責(zé)任制度。同時(shí),平等就業(yè)權(quán)的司法救濟(jì)并非萬能,應(yīng)當(dāng)認(rèn)識(shí)司法救濟(jì)的有限性,避免平等就業(yè)權(quán)司法救濟(jì)的"法院中心主義"陷阱。構(gòu)造平等就業(yè)權(quán)司法救濟(jì)體系的總體目標(biāo)是:平等就業(yè)權(quán)司法救濟(jì)應(yīng)當(dāng)符合國家治理現(xiàn)代化轉(zhuǎn)型要求,依法構(gòu)建集黨的領(lǐng)導(dǎo)與政策、國家立法、依法行政、公正司法、民眾守法等于一體的多元解紛機(jī)制,堅(jiān)持整體和諧主義法治觀,堅(jiān)持對(duì)話與合作,綜合運(yùn)用協(xié)商、調(diào)解等非訴訟程序機(jī)制,使司法內(nèi)部救濟(jì)與司法外部資源相得益彰,最終形成具有中國特色的平等就業(yè)權(quán)司法救濟(jì)體系。
[Abstract]:Right remedy is an important standard to measure the soundness of law enforcement system. The construction of equal employment right judicial relief system is an important embodiment of implementing the rule of law to strengthen human rights judicial protection, and the construction of equal employment right judicial relief system. We should give full play to the leading role of legislation, including establishing and perfecting the system of unconstitutional review and constitutional litigation, perfecting the mechanism of handling labor disputes, strengthening the three major litigation mechanisms, and developing the judicial relief system such as public interest litigation. The construction of judicial remedy system of equal employment right should also strengthen the system of legal responsibility. At the same time, the judicial remedy of equal employment right is not omnipotent, and the limitation of judicial remedy should be recognized. To avoid the "court-centrism" trap of judicial relief of equal employment right. The overall goal of constructing the judicial relief system of equal employment right is that the judicial relief of equal employment right should conform to the requirements of the modernization transformation of national governance. In accordance with the law, the Party's leadership and policy, national legislation, administration by law, fair administration of justice, and the law abiding by the people are tantamount to a pluralistic mechanism for resolving disputes, adhering to the concept of overall harmony of the rule of law, insisting on dialogue and cooperation, and making comprehensive use of consultation. Mediation and other non-procedural mechanisms make the judicial internal relief and external judicial resources complement each other and finally form a judicial relief system with Chinese characteristics of equal employment rights.
