【摘要】：隨著我國市場(chǎng)經(jīng)濟(jì)結(jié)構(gòu)的調(diào)整和勞動(dòng)用工制度改革的深入，勞動(dòng)關(guān)系的雙方當(dāng)事人之間因勞動(dòng)權(quán)利和義務(wù)而發(fā)生的糾紛急劇上升，，我國的勞動(dòng)爭(zhēng)議處理制度已經(jīng)在很多方面不能夠適應(yīng)甚至滯后于市場(chǎng)經(jīng)濟(jì)條件下勞動(dòng)關(guān)系的發(fā)展需要，出現(xiàn)了諸如勞動(dòng)爭(zhēng)議處理周期長、成本高、不利于保護(hù)勞動(dòng)者的合法利益等弊端。筆者是一名從事民事審判工作的法官，審理過大量的勞動(dòng)爭(zhēng)議訴訟案件，在實(shí)際工作中能深切體會(huì)到勞動(dòng)爭(zhēng)議處理制度存在的問題，深感這項(xiàng)制度亟待進(jìn)一步完善。本文試圖通過對(duì)我國現(xiàn)行勞動(dòng)爭(zhēng)議處理制度的反思及國外市場(chǎng)經(jīng)濟(jì)國家勞動(dòng)爭(zhēng)議處理制度的比較，嘗試性地就建立一個(gè)既符合我國國情，又符合市場(chǎng)經(jīng)濟(jì)運(yùn)行規(guī)則且與國際接軌的勞動(dòng)爭(zhēng)議處理制度提出了相應(yīng)的建議。 全文共分四部分。第一部分對(duì)我國現(xiàn)行勞動(dòng)爭(zhēng)議處理制度予以概述，以期對(duì)這項(xiàng)制度的歷史發(fā)展和現(xiàn)行法律規(guī)定(現(xiàn)狀)有一個(gè)客觀的了解和認(rèn)識(shí)；第二部分通過對(duì)中外勞動(dòng)爭(zhēng)議處理制度在調(diào)解、仲裁、訴訟處理方式的規(guī)定等方面的比較，以期為進(jìn)一步完善我國的勞動(dòng)爭(zhēng)議處理制度提供一點(diǎn)有益的借鑒和幫助；第三部分是對(duì)勞動(dòng)爭(zhēng)議處理在實(shí)踐中的現(xiàn)狀及暴露的問題(負(fù)面作用)進(jìn)行分析，這些現(xiàn)狀和問題應(yīng)是改革與完善的關(guān)鍵之所在，從爭(zhēng)議處理體制、機(jī)構(gòu)、以及立法問題等方面挖掘該項(xiàng)制度諸多弊端的根源，以期對(duì)該項(xiàng)制度的改革與完善有所裨益；第四部分從現(xiàn)行勞動(dòng)爭(zhēng)議制度存在的合理性及存在的問題，立足實(shí)踐，提出改革與完善勞動(dòng)爭(zhēng)議處理制度的構(gòu)想。
[Abstract]:With the adjustment of market economic structure and the deepening of labor employment system reform, the disputes between the two parties of labor relations due to labor rights and obligations have risen sharply. China's labor dispute handling system has been unable to adapt to or even lag behind the needs of the development of labor relations under the conditions of market economy in many aspects, such as the long period of labor dispute settlement, high cost, The author is a judge engaged in civil trial, who has tried a large number of labor dispute litigation cases, and can deeply understand the problems existing in the labor dispute handling system in practical work. This paper attempts to establish a labor dispute settlement system in accordance with the situation of our country through the introspection of the current labor dispute handling system in our country and the comparison of the labor dispute settlement system in foreign market economy countries. It also puts forward the corresponding suggestions of labor dispute settlement system which accords with the market economy operation rules and is in line with international standards. The paper is divided into four parts. The first part gives an overview of the current labor dispute handling system in China, in order to have an objective understanding and understanding of the historical development of this system and the current legal provisions. The second part through the domestic and foreign labor dispute handling system in the mediation, the arbitration, the lawsuit settlement way stipulation and so on aspect comparison, hoped for further consummates our country labor dispute processing system to provide some beneficial reference and the help; The third part is to analyze the current situation of labor dispute handling in practice and the exposed problems (negative effects), which should be the key to reform and perfection. In order to benefit the reform and perfection of the system, part 4th is based on the rationality and problems of the current labor dispute system. This paper puts forward the idea of reforming and perfecting the labor dispute handling system.
