【摘要】： 本文是一篇關于貴陽市“背篼工”及其權益保護問題的實證研究。全文在借鑒前人研究成果的基礎上，主要以花溪區(qū)“背篼工”生存狀況為切入點，綜合運用“制度化了的半工半耕過密型農(nóng)業(yè)生產(chǎn)理論”、“文化資本”、“底邊階層”、“社會排斥”等社會學理論和《中華人民共和國憲法》、《中華人民共和國勞動法》、《國務院關于解決農(nóng)民工問題的若干意見》等政策法規(guī)剖析了“背篼工”群體存在的原因、面臨的邊緣化處境及妥善解決這一問題的意義。 本文第二章從“背篼工”整體收入水平低、時時面臨生存危機、常常遭受不法侵害等八個方面展現(xiàn)了他們所面臨的弱勢處境。在前述調(diào)查分析的基礎上，本文第三章運用詹姆斯·C·斯科特、馬歇爾等學者的社會學理論及相關政策法規(guī)，從“背篼工”的生存權、工作權、社會權三個方面探析了他們在城鎮(zhèn)社會所面臨的權益缺失狀況并淺析了其原因。 面對上述三種權利的缺失，本文第四章結合實際有針對性的提出了相應的解決辦法。文中建議：“建立包括“背篼工”群體在內(nèi)的最低生活保障制度”以保障“背篼工”的生存權；從將“背篼工”納入城鎮(zhèn)職業(yè)介紹機構公益服務范圍和積極開展針對“背篼工”的對外勞務輸兩個方面入手，從而為“背篼工”搭建合理的就業(yè)平臺來保障他們的工作權；免費實施對“背篼工”的教育培訓以保障他們的社會權。 此外，文中還通過對羅爾斯《正義新論》中有關“機會平等與差別正義”相結合的原則和沈宗靈在《法理學》等著作中有關法律公正價值的闡述，深入分析了上述應對措施是符合法律所追求的平等、正義原則的，，也是符合我國新世紀所極力倡導的制度價值的。
[Abstract]:This paper is an empirical study on the problem of "basket workers" and their rights and interests protection in Guiyang. Based on the previous research results, this paper mainly focuses on the living conditions of "basket workers" in Huaxi district.
