【摘要】：2010年10月16日6時(shí),河南平煤集團(tuán)發(fā)生瓦斯突出事故,三十七人被困,其中二十人死亡。我國平均三天就會發(fā)生一起煤礦事故。煤炭挖掘業(yè)作為高危行業(yè)的一種,具有事故地域分布廣、事故發(fā)生頻繁和事故死亡人數(shù)高的特點(diǎn)。煤礦事故后礦工工傷救濟(jì)的實(shí)現(xiàn)水平與礦工及其家庭的生活質(zhì)量息息相關(guān)。作者針對煤礦事故中工傷人員的權(quán)利救濟(jì)中始終存在礦工參保率低、救濟(jì)水平不高,保障體系不完善等問題,通過對侵權(quán)責(zé)任、侵權(quán)損害賠償、工傷保險(xiǎn)等內(nèi)容的研究和對工傷法律救濟(jì)現(xiàn)狀的分析,發(fā)現(xiàn)我國工傷保險(xiǎn)救濟(jì)現(xiàn)狀普遍存在舉證難、賠償金額低、維權(quán)時(shí)間久等缺憾。作者在探討礦工群體性文化水平不高、維權(quán)意識薄弱、生活水平較低的特點(diǎn)后,認(rèn)為工傷保險(xiǎn)條例應(yīng)當(dāng)在訴訟程序、金額確定、范圍厘定方面做出適當(dāng)修改。同時(shí)提出,應(yīng)當(dāng)將建立預(yù)防 救濟(jì) 康復(fù)的工傷救濟(jì)模式作為工傷救濟(jì)工作的目標(biāo)。最后建議建立銜接順暢的工傷救濟(jì)體系,旨在為煤礦事故工傷人員尋得賠償依據(jù)完備、救濟(jì)內(nèi)容全面、補(bǔ)償力度適當(dāng)?shù)姆梢罁?jù)。
[Abstract]:At 6 October 16, 2010, a gas outburst occurred in Henan Ping Coal Group, and thirty-seven people were trapped, and twenty of them died. An average of three days in China will have a coal mine accident. Coal mining industry, as a high risk industry, has the characteristics of wide area of accident, frequent accidents and high number of deaths. The realization level of the relief for miners and workers after the coal mine accident is closely related to the quality of life of the miners and their families. The author for work-related injuries in the coal mine accident relief existence miners insurance rate is low, the relief level is not high, security system is not perfect, through the research on the tort liability, tort compensation, industrial injury insurance and the status of the content of industrial injury relief legal analysis, found that China's industrial injury insurance relief situation exists the burden of proof is difficult, the amount of compensation is low, waiting time regret rights. After discussing the characteristics of miners' group culture, such as low level of group culture, weak awareness of rights protection and low living standard, I believe that industrial injury insurance regulations should be modified in terms of litigation procedure, amount determination and scope determination. At the same time, it is proposed that the establishment of relief and rehabilitation work injury relief mode should be the goal of the work injury relief work. Finally, it is suggested to establish a smooth industrial injury relief system, aiming to find a legal basis for the coal mine accident workers to have a complete compensation basis, a comprehensive remedy and appropriate compensation efforts.
