【摘要】：股權(quán)眾籌作為互聯(lián)網(wǎng)金融的典型表現(xiàn)之一,其監(jiān)管制度的缺失,在社會(huì)分析看來可表現(xiàn)為社會(huì)制度頂層設(shè)計(jì)的缺乏與社會(huì)自發(fā)的制度較為多見兩方面。文章認(rèn)為,其產(chǎn)生的原因在于法治化監(jiān)管的保守社會(huì)意識(shí)與股權(quán)眾籌的社會(huì)運(yùn)行具有矛盾,而互聯(lián)網(wǎng)金融監(jiān)管的未來發(fā)展方向仍應(yīng)走法治化路徑,其路徑設(shè)計(jì)應(yīng)尊重社會(huì)自發(fā)制度的經(jīng)驗(yàn)。
[Abstract]:As one of the typical manifestations of Internet finance, the lack of supervision system of equity crowdfunding can be seen in two aspects: the lack of top-level design of social system and the spontaneous system of society. The paper holds that the reason lies in the contradiction between the conservative social consciousness of legalized supervision and the social operation of equity crowdfunding, and the future development direction of Internet financial supervision should still take the path of legalization. Its path design should respect the experience of social spontaneous system.
