【摘要】：發(fā)現(xiàn)行為、感知違法性,對違法行為進行定性,進而確定責(zé)任主體、責(zé)任內(nèi)容是實施煙草專賣行政處罰必經(jīng)邏輯。在日常執(zhí)法過程中,執(zhí)法人員在"確定責(zé)任主體"環(huán)節(jié)容易出現(xiàn)些許錯誤和瑕疵,這會導(dǎo)致后續(xù)處理失去合法性,從而導(dǎo)致諸如案卷評查不合格、行政復(fù)議甚至行政訴訟的后果,降低執(zhí)法效率,增加執(zhí)法成本。為理清責(zé)任主體的范圍,這篇文章從實踐出發(fā),探討了研究意義,列舉常見的錯誤情形,以及根據(jù)一定原則認定復(fù)雜責(zé)任主體的方法,以剖析和整改。
[Abstract]:Finding behavior, perceiving illegality, qualitative analysis of illegal behavior, and then determining the subject of responsibility, the content of responsibility is that the implementation of administrative punishment of tobacco monopoly must be logical. In the daily process of law enforcement, law enforcement officials are prone to some mistakes and defects in the "determination of the subject of responsibility", which will lead to the loss of legitimacy of the follow-up process, which will lead to, for example, unqualified case file reviews. The consequences of administrative reconsideration and even administrative litigation reduce the efficiency of law enforcement and increase the cost of law enforcement. In order to clarify the scope of the subject of responsibility, this paper probes into the significance of the study from practice, enumerates the common error situations, and analyzes and corrects the method of identifying the subject of complex responsibility according to certain principles.
