我國網(wǎng)絡(luò)廣告的法律規(guī)制研究

【摘要】:網(wǎng)絡(luò)廣告法律規(guī)制是廣告市場監(jiān)管的重要組成部分。對于規(guī)制網(wǎng)絡(luò)廣告違法行為,確保網(wǎng)絡(luò)廣告市場的順利發(fā)展具有重要意義。網(wǎng)絡(luò)廣告的法律規(guī)制可以有效地規(guī)制市場主體、保護(hù)網(wǎng)民隱私安全、維護(hù)網(wǎng)絡(luò)廣告市場秩序。目前,我國網(wǎng)絡(luò)廣告市場亂象叢生、魚龍混雜,網(wǎng)民的利益受到侵犯的情況時有發(fā)生,然而當(dāng)前我國的網(wǎng)絡(luò)廣告法律規(guī)制還不夠完善、缺乏嚴(yán)格的市場準(zhǔn)入和審查機(jī)制,使得網(wǎng)民的利益以及消費(fèi)者權(quán)益受到嚴(yán)重影響。如果網(wǎng)絡(luò)廣告法律制度得不到有效完善,那么網(wǎng)絡(luò)廣告的市場價值就難以全面實(shí)現(xiàn)。所以,現(xiàn)在亟待要做的就是借鑒先進(jìn)國家的經(jīng)驗(yàn),完善我國的網(wǎng)絡(luò)廣告法律制度。文章的切入點(diǎn)是網(wǎng)絡(luò)廣告法律規(guī)制基本問題,在對美國、歐盟等國的網(wǎng)絡(luò)廣告法律制度的立法進(jìn)行文本分析的基礎(chǔ)上,對目前我國網(wǎng)絡(luò)法律制度的現(xiàn)狀以及所存在的主要問題進(jìn)行深入分析,對完善我國網(wǎng)絡(luò)廣告法律制度提出自己的一些對策和構(gòu)想。本文一共分為五個章節(jié):第一章:“緒論”。主要闡述完善我國網(wǎng)絡(luò)廣告法律體系的研究背景、研究意義、研究狀況、研究方法。第二章:“網(wǎng)絡(luò)廣告概述”。本章對網(wǎng)絡(luò)廣告定義做出了界定,介紹網(wǎng)絡(luò)廣告的表現(xiàn)形式和網(wǎng)絡(luò)廣告的發(fā)展?fàn)顩r以及網(wǎng)絡(luò)廣告的法律特征。第三章:“我國網(wǎng)絡(luò)廣告的立法現(xiàn)狀及其存在的問題”。本章主要闡述我國目前網(wǎng)絡(luò)廣告的立法現(xiàn)狀以及我國網(wǎng)絡(luò)廣告現(xiàn)存法律規(guī)制中存在的問題。第四章:“域外國家網(wǎng)絡(luò)廣告的法律規(guī)制探析”。本章著重介紹的是美國、歐盟網(wǎng)絡(luò)廣告法律制度和這些國家的網(wǎng)絡(luò)廣告法律規(guī)制體系對我國的借鑒意義。第五章:“對我國網(wǎng)絡(luò)廣告規(guī)制的建議”。針對我國當(dāng)前網(wǎng)絡(luò)廣告法律制度存在的主要問題,在網(wǎng)絡(luò)廣告主體的界定、網(wǎng)絡(luò)廣告內(nèi)容以及對網(wǎng)絡(luò)廣告中的不正當(dāng)競爭等方面提出對應(yīng)的完善措施。
[Abstract]:The legal regulation of network advertisement is an important part of advertising market regulation. It is of great significance to regulate the illegal behavior of network advertisement and ensure the smooth development of network advertisement market. The legal regulation of network advertisement can effectively regulate the market main body, protect the privacy and safety of the Internet users, and maintain the network advertisement market order. At present, the network advertisement market of our country is in chaos, the fish and the dragon are mixed, the interests of the Internet users are violated, however, the legal regulation of the network advertisement in our country is not perfect, and the strict market access and the review mechanism are lacking. So that the interests of the netizens and the rights and interests of the consumers are seriously affected. If that legal system of the network advertisement is not perfect, the market value of the network advertisement is difficult to fully realize. Therefore, it is urgent to learn from the experience of the advanced countries and improve the legal system of network advertisement in our country. The entry point of the article is the basic problem of the legal regulation of the network advertisement, on the basis of the text analysis of the legislation of the network advertisement legal system of the United States and the European Union, the present situation and the main problems of the present network legal system are analyzed in detail. This paper puts forward some countermeasures and ideas for perfecting the legal system of network advertisement in our country. This paper is divided into five chapters: Chapter one: "introduction". This paper mainly expounds the research background, research significance, research situation and research method of the legal system of network advertisement in our country. Chapter II: "Overview of network advertising". This chapter defines the definition of network advertisement, introduces the form of network advertisement and the development of network advertisement and the legal characteristic of network advertisement. Chapter 3: "The Current Situation of the Legislation of Internet Advertising in China and the Existing Problems". This chapter mainly expounds the current legal status of the network advertisement in our country and the existing problems in the existing legal regulation of the network advertisement in our country. Chapter 4: "An Analysis of the Legal Regulation of the Network Advertisement of the Extraterritorial State". This chapter mainly introduces the American, European network advertisement legal system and the network advertisement legal regulation system of these countries to our country's reference significance. Chapter V: "Suggestions on the Regulation of Internet Advertising in China". In view of the main problems of the current legal system of network advertisement in our country, the corresponding improvement measures are put forward in the definition of the main body of the network advertisement, the content of the network advertisement and the unfair competition in the network advertisement.
