【摘要】：國有資產(chǎn)在我國的國民經(jīng)濟中占有很大的比重。按照我國憲法的規(guī)定,全民所有國有資產(chǎn),由國家代為行使并準予由其他行政部門依法管理。按照經(jīng)濟用途,可分為經(jīng)營性國有資產(chǎn)、行政性國有資產(chǎn)和資源性國有資產(chǎn)三類。海南農(nóng)墾是農(nóng)業(yè)企業(yè),海南農(nóng)墾最重要的元素當然是土地。海南農(nóng)墾土地既有經(jīng)營性國有資產(chǎn),又有資源性國有資產(chǎn)。如今,海南農(nóng)墾正在展開一場深刻的變革,將其國有資產(chǎn)統(tǒng)一納入到省國資委進行監(jiān)管,但是這并不能從根本上解決海南農(nóng)墾存在的國有資產(chǎn)監(jiān)管問題。本文立足于海南農(nóng)墾改革的核心思想,結(jié)合目前海南農(nóng)墾國有資產(chǎn)監(jiān)管的現(xiàn)狀,從經(jīng)濟法一般理論著手,試圖提出適用于海南農(nóng)墾這一特殊的國有資產(chǎn)監(jiān)管制度的建議。文章共分四部分,主要內(nèi)容如下：第一部分為海南農(nóng)墾國有資產(chǎn)監(jiān)管制度的發(fā)展變遷。簡要介紹海南農(nóng)墾的起源與改革過程,分析現(xiàn)行海南農(nóng)墾國有資產(chǎn)管理制度的內(nèi)容,闡明海南農(nóng)墾國有資產(chǎn)管理所具有的特殊性。第二部分為海南農(nóng)墾國有資產(chǎn)監(jiān)管體系存在的問題。針對現(xiàn)行海南農(nóng)墾國有資產(chǎn)監(jiān)管制度的規(guī)定,結(jié)合海南農(nóng)墾自身的特點,找出問題。第三部分為國有資產(chǎn)監(jiān)管的域外經(jīng)驗及啟示。主要是通過分析西方發(fā)達國家的國有資產(chǎn)監(jiān)管制度,得出能夠解決海南農(nóng)墾國有資產(chǎn)監(jiān)管問題的啟示。第四部分為海南農(nóng)墾國有資產(chǎn)監(jiān)管制度的完善與建議。重點從海南農(nóng)墾存在的特殊問題入手,特殊問題需要特殊對待,提出適用于海南農(nóng)墾國有資產(chǎn)監(jiān)管的方案。同時也希望對全國國有資產(chǎn)監(jiān)管提供借鑒意義。
[Abstract]:State-owned assets occupy a large proportion in our national economy. In accordance with the provisions of China's Constitution, all state-owned assets shall be exercised by the State on behalf of the State and allowed to be administered by other administrative departments in accordance with the law. According to economic use, can be divided into operating state-owned assets, administrative state-owned assets and resource state-owned assets three categories. Hainan Agricultural Reclamation is an agricultural enterprise. The most important element of Hainan Agricultural Reclamation is of course the land. Hainan land reclamation not only operating state-owned assets, but also resources of state-owned assets. Today, Hainan Agricultural Reclamation is carrying out a profound change to bring its state-owned assets into the supervision of the provincial SASAC, but this can not fundamentally solve the problems of the state-owned assets supervision existing in Hainan Agricultural Reclamation. Based on the core idea of Hainan Agricultural Reclamation Reform and the present situation of state-owned assets supervision of Hainan Agricultural Reclamation, this paper tries to put forward some suggestions on the special state-owned assets supervision system, which is suitable for Hainan Agricultural Reclamation, based on the general theory of economic law. The article is divided into four parts, the main contents are as follows: the first part is about the development and change of the state-owned assets supervision system of Hainan Agricultural Reclamation. This paper briefly introduces the origin and reform process of Hainan Agricultural Reclamation, analyzes the contents of the current state-owned assets management system of Hainan Agricultural Reclamation, and clarifies the particularity of Hainan Agricultural Reclamation State-owned assets Management. The second part is the problems existing in the supervision system of Hainan agricultural reclamation state-owned assets. In view of the current regulation of the state-owned assets supervision system of Hainan Agricultural Reclamation, combined with the characteristics of Hainan Agricultural Reclamation itself, the problems are found out. The third part is the experience and enlightenment of state-owned assets supervision. Through the analysis of the state-owned assets supervision system in western developed countries, the enlightenment can be drawn to solve the problems of state-owned assets supervision in Hainan Agricultural Reclamation. The fourth part is about the perfection and suggestion of the supervision system of the state-owned assets of Hainan Agricultural Reclamation. From the point of view of the special problems existing in Hainan agricultural reclamation, special problems need special treatment, and put forward a scheme applicable to the supervision and control of the state-owned assets of Hainan agricultural reclamation. At the same time, it also hopes to provide reference for the national supervision of state-owned assets.
