【摘要】：網(wǎng)絡(luò)個(gè)體經(jīng)營者法律地位缺乏立法的明確規(guī)定,導(dǎo)致其合法權(quán)益得不到立法保障。本文通過對商人內(nèi)涵的界定論證網(wǎng)絡(luò)個(gè)體經(jīng)營者的商主體身份,并進(jìn)而確定其具體商主體類型。在此基礎(chǔ)上,本文提出了完善網(wǎng)絡(luò)個(gè)體經(jīng)營者商事登記制度的具體措施;最后提出了針對民法典、個(gè)體工商戶及商事登記制度的具體立法完善建議,以保障網(wǎng)絡(luò)個(gè)體經(jīng)營者的合法權(quán)益。
[Abstract]:The legal status of network self-employed operators is not clearly regulated by legislation, which leads to their legal rights and interests are not protected by legislation. Through the definition of the connotation of merchants, this paper demonstrates the identity of business subject of network self-employed operators, and then determines the specific types of business subjects of network self-employed operators. On this basis, this paper puts forward the specific measures to perfect the commercial registration system of network self-employed operators; Finally, the author puts forward some suggestions to perfect the civil code, the registration system of individual industrial and commercial households, and commercial registration system in order to protect the legitimate rights and interests of the network self-employed operators.
