政府采購(gòu)環(huán)!昂诿麊巍狈芍贫妊芯

【摘要】:政府采購(gòu)作為一種政府行為,不僅體現(xiàn)了政府對(duì)于采購(gòu)活動(dòng)的要求,還承擔(dān)著政府對(duì)于市場(chǎng)的引領(lǐng)、指導(dǎo)作用。政府采購(gòu)一直以來(lái)僅有《政府采購(gòu)法》、《采購(gòu)法實(shí)施條例》對(duì)其從采購(gòu)流程、采購(gòu)合同等方面做出專(zhuān)門(mén)性、程序性的規(guī)定。2014年新《環(huán)保法》對(duì)于政府采購(gòu)對(duì)象提出了“環(huán)保、節(jié)能”的新要求,但政府采購(gòu)相關(guān)法律法規(guī)并未根據(jù)此要求進(jìn)行調(diào)整,出現(xiàn)了采購(gòu)活動(dòng)與“環(huán)保、節(jié)能”相脫節(jié)的情況。為能使政府采購(gòu)活動(dòng)達(dá)到這一要求并同時(shí)實(shí)現(xiàn)綠色采購(gòu)的目的,本文在借鑒近年來(lái)相關(guān)領(lǐng)域出現(xiàn)的“黑名單”制度的前提下,在政府采購(gòu)領(lǐng)域提出建立環(huán)保“黑名單”制度的構(gòu)想。文章分為五個(gè)部分。第一部分引言,提出政府采購(gòu)與環(huán)保節(jié)能無(wú)直接關(guān)聯(lián),但法律又對(duì)政府采購(gòu)的環(huán)保化提出要求的矛盾。并對(duì)此問(wèn)題進(jìn)行分析,提出解決方式——建立政府采購(gòu)環(huán)!昂诿麊巍敝贫取5诙糠謱(duì)政府采購(gòu)環(huán)!昂诿麊巍敝贫茸龀龈攀,引出環(huán)!昂诿麊巍敝贫鹊母拍詈湍康,以及制度形成的理論基礎(chǔ)和現(xiàn)實(shí)依據(jù)。此項(xiàng)制度根據(jù)《環(huán)境保護(hù)法》和《政府采購(gòu)法》要求,借鑒了政府采購(gòu)目錄制定的方式和表現(xiàn)形式,同樣以目錄的形式,將采購(gòu)主體和采購(gòu)對(duì)象一一進(jìn)行規(guī)范。政府采購(gòu)“黑名單”與采購(gòu)目錄同時(shí)制作,都由政府采購(gòu)專(zhuān)門(mén)機(jī)構(gòu)負(fù)責(zé)相關(guān)實(shí)施細(xì)則。第三部分提出了政府采購(gòu)環(huán)!昂诿麊巍敝贫鹊闹饕獦(gòu)架,包括基本內(nèi)容、“黑名單”的進(jìn)入和退出機(jī)制以及制度實(shí)施方式!昂诿麊巍敝贫鹊幕緝(nèi)容包括主體構(gòu)建、制作流程、運(yùn)行周期、表現(xiàn)形式以及監(jiān)督!昂诿麊巍钡倪M(jìn)入和退出機(jī)制根據(jù)規(guī)范內(nèi)容的不同分別對(duì)采購(gòu)對(duì)象“黑名單”(包括對(duì)采購(gòu)的產(chǎn)品、工程、服務(wù)等)、供應(yīng)商“黑名單”與代理機(jī)構(gòu)“黑名單”做出構(gòu)建,將不符合要求的對(duì)象及主體規(guī)避在采購(gòu)活動(dòng)之外。第四部分提出了政府采購(gòu)環(huán)保“黑名單”制度的立法模式建議,建議將“黑名單”制度通過(guò)法律法規(guī)的形式加以確立以保障其運(yùn)行,并提出相關(guān)立法建議。第五部分為結(jié)論部分,通過(guò)梳理整篇文章的脈絡(luò),提出政府采購(gòu)環(huán)!昂诿麊巍敝贫葘⒃谡少(gòu)領(lǐng)域發(fā)揮出創(chuàng)造性作用。
[Abstract]:As a kind of government behavior, government procurement not only reflects the requirements of government procurement activities, but also undertakes the guidance and guidance of the government to the market. Government procurement has always been the only "government procurement law". The regulations on the implementation of the "procurement law" have made it specialized in the procurement process, procurement contracts, and so on. The new "Environmental Protection Law" in 2014 puts forward new requirements of "environmental protection and energy conservation" for government procurement objects, but the laws and regulations related to government procurement have not been adjusted in accordance with this requirement, resulting in procurement activities and "environmental protection," Energy saving "disjointed." In order to achieve this requirement and achieve the purpose of green procurement at the same time, this paper draws lessons from the "blacklist" system in related fields in recent years. In the field of government procurement, the establishment of environmental protection "blacklist" system is proposed. The article is divided into five parts. In the first part, the author points out that there is no direct relation between government procurement and environmental protection and energy conservation, but the law demands the environmental protection of government procurement. And this problem is analyzed, and the solution is put forward, which is to establish the "blacklist" system of environmental protection in government procurement. The second part gives an overview of the "blacklist" system of environmental protection in government procurement, and introduces the concept and purpose of the "blacklist" system of environmental protection, as well as the theoretical basis and practical basis for the formation of the system. According to the requirements of "Environmental Protection Law" and "Government Procurement Law", this system draws lessons from the ways and manifestations of government procurement catalogue, and standardizes the procurement subject and object one by one in the form of catalogue. The "blacklist" of government procurement is produced at the same time as the procurement catalogue, and the relevant implementation rules are taken care of by specialized agencies of government procurement. The third part puts forward the main framework of the "blacklist" system of environmental protection in government procurement, including the basic content, the entry and exit mechanism of "blacklist" and the way of implementing the system. The basic contents of blacklist system include subject construction, production process, operation cycle, manifestation and supervision. The entry and exit mechanisms of the "blacklist" are constructed according to the different contents of the specification to the "blacklist" of the purchasing object (including products, works, services, etc.), the "blacklist" of the supplier and the "blacklist" of the agency. Circumvent objects and subjects that do not meet the requirements outside the procurement activities. In the fourth part, the author puts forward the legislative model of the "blacklist" system of environmental protection in government procurement, and suggests that the "blacklist" system should be established in the form of laws and regulations to ensure its operation, and the relevant legislative suggestions are put forward. The fifth part is the conclusion part, through combing the whole article's vein, proposes that the government procurement environmental protection "blacklist" system will play a creative role in the government procurement field.
