政府采購環(huán)!昂诿麊巍狈芍贫妊芯

【摘要】:政府采購作為一種政府行為,不僅體現(xiàn)了政府對于采購活動的要求,還承擔著政府對于市場的引領、指導作用。政府采購一直以來僅有《政府采購法》、《采購法實施條例》對其從采購流程、采購合同等方面做出專門性、程序性的規(guī)定。2014年新《環(huán)保法》對于政府采購對象提出了“環(huán)保、節(jié)能”的新要求,但政府采購相關法律法規(guī)并未根據(jù)此要求進行調整,出現(xiàn)了采購活動與“環(huán)保、節(jié)能”相脫節(jié)的情況。為能使政府采購活動達到這一要求并同時實現(xiàn)綠色采購的目的,本文在借鑒近年來相關領域出現(xiàn)的“黑名單”制度的前提下,在政府采購領域提出建立環(huán)保“黑名單”制度的構想。文章分為五個部分。第一部分引言,提出政府采購與環(huán)保節(jié)能無直接關聯(lián),但法律又對政府采購的環(huán);岢鲆蟮拿。并對此問題進行分析,提出解決方式——建立政府采購環(huán)!昂诿麊巍敝贫。第二部分對政府采購環(huán)!昂诿麊巍敝贫茸龀龈攀,引出環(huán)!昂诿麊巍敝贫鹊母拍詈湍康,以及制度形成的理論基礎和現(xiàn)實依據(jù)。此項制度根據(jù)《環(huán)境保護法》和《政府采購法》要求,借鑒了政府采購目錄制定的方式和表現(xiàn)形式,同樣以目錄的形式,將采購主體和采購對象一一進行規(guī)范。政府采購“黑名單”與采購目錄同時制作,都由政府采購專門機構負責相關實施細則。第三部分提出了政府采購環(huán)!昂诿麊巍敝贫鹊闹饕獦嫾,包括基本內容、“黑名單”的進入和退出機制以及制度實施方式!昂诿麊巍敝贫鹊幕緝热莅ㄖ黧w構建、制作流程、運行周期、表現(xiàn)形式以及監(jiān)督。“黑名單”的進入和退出機制根據(jù)規(guī)范內容的不同分別對采購對象“黑名單”(包括對采購的產(chǎn)品、工程、服務等)、供應商“黑名單”與代理機構“黑名單”做出構建,將不符合要求的對象及主體規(guī)避在采購活動之外。第四部分提出了政府采購環(huán)!昂诿麊巍敝贫鹊牧⒎J浇ㄗh,建議將“黑名單”制度通過法律法規(guī)的形式加以確立以保障其運行,并提出相關立法建議。第五部分為結論部分,通過梳理整篇文章的脈絡,提出政府采購環(huán)!昂诿麊巍敝贫葘⒃谡少忣I域發(fā)揮出創(chuàng)造性作用。
[Abstract]:As a kind of government behavior, government procurement not only reflects the requirements of government procurement activities, but also undertakes the guidance and guidance of the government to the market. Government procurement has always been the only "government procurement law". The regulations on the implementation of the "procurement law" have made it specialized in the procurement process, procurement contracts, and so on. The new "Environmental Protection Law" in 2014 puts forward new requirements of "environmental protection and energy conservation" for government procurement objects, but the laws and regulations related to government procurement have not been adjusted in accordance with this requirement, resulting in procurement activities and "environmental protection," Energy saving "disjointed." In order to achieve this requirement and achieve the purpose of green procurement at the same time, this paper draws lessons from the "blacklist" system in related fields in recent years. In the field of government procurement, the establishment of environmental protection "blacklist" system is proposed. The article is divided into five parts. In the first part, the author points out that there is no direct relation between government procurement and environmental protection and energy conservation, but the law demands the environmental protection of government procurement. And this problem is analyzed, and the solution is put forward, which is to establish the "blacklist" system of environmental protection in government procurement. The second part gives an overview of the "blacklist" system of environmental protection in government procurement, and introduces the concept and purpose of the "blacklist" system of environmental protection, as well as the theoretical basis and practical basis for the formation of the system. According to the requirements of "Environmental Protection Law" and "Government Procurement Law", this system draws lessons from the ways and manifestations of government procurement catalogue, and standardizes the procurement subject and object one by one in the form of catalogue. The "blacklist" of government procurement is produced at the same time as the procurement catalogue, and the relevant implementation rules are taken care of by specialized agencies of government procurement. The third part puts forward the main framework of the "blacklist" system of environmental protection in government procurement, including the basic content, the entry and exit mechanism of "blacklist" and the way of implementing the system. The basic contents of blacklist system include subject construction, production process, operation cycle, manifestation and supervision. The entry and exit mechanisms of the "blacklist" are constructed according to the different contents of the specification to the "blacklist" of the purchasing object (including products, works, services, etc.), the "blacklist" of the supplier and the "blacklist" of the agency. Circumvent objects and subjects that do not meet the requirements outside the procurement activities. In the fourth part, the author puts forward the legislative model of the "blacklist" system of environmental protection in government procurement, and suggests that the "blacklist" system should be established in the form of laws and regulations to ensure its operation, and the relevant legislative suggestions are put forward. The fifth part is the conclusion part, through combing the whole article's vein, proposes that the government procurement environmental protection "blacklist" system will play a creative role in the government procurement field.
