【摘要】：信息調(diào)查公司(俗稱“私人偵探”)在我國當(dāng)前還只是停留在初步發(fā)展階段,尚屬于新事物的范疇,以致學(xué)術(shù)界及實(shí)踐部門對(duì)其存廢問題一直爭論不休。信息調(diào)查公司隨著強(qiáng)大的市場需求,有逐步發(fā)展壯大的趨勢,但認(rèn)識(shí)的偏頗和制度的缺失,使得行業(yè)發(fā)展呈現(xiàn)出無序局面,以致產(chǎn)生了諸多負(fù)面效應(yīng)。本文結(jié)合我國信息調(diào)查公司的現(xiàn)狀,比照域外的經(jīng)驗(yàn)教訓(xùn),從規(guī)范層面對(duì)信息調(diào)查公司的法律定位、運(yùn)行規(guī)范以及行業(yè)監(jiān)管等進(jìn)行了深入地探討,為我國信息調(diào)查公司的良性發(fā)展提供保障。故本文主要從四個(gè)方面對(duì)該主題進(jìn)行研究:第一部分闡述了信息調(diào)查公司的理論基礎(chǔ),就信息調(diào)查公司的含義、淵源、背景以及現(xiàn)狀進(jìn)行分析。這一章能讓我們對(duì)信息調(diào)查公司有了初步的了解,并且他在我國,具體到寧波的實(shí)踐情況作了詳細(xì)的闡述。第二部分分析了信息調(diào)查公司在我國發(fā)展過程中所存在的不足。就目前我國的信息調(diào)查公司的發(fā)展來看,我國的信息調(diào)查公司因其合法性受到質(zhì)疑,主要是因其與偵查權(quán)、隱私權(quán)、人身安全存在一定的沖突,該部門就闡述了該種沖突的不存在。而信息調(diào)查公司具體的問題則體現(xiàn)在公司的運(yùn)行規(guī)范以及在監(jiān)督問題上的缺失。第三部分是關(guān)于域外關(guān)于信息調(diào)查公司的經(jīng)驗(yàn)借鑒。意欲通過國外信息調(diào)查公司的發(fā)展情況,以及域外幾個(gè)重要國家對(duì)信息調(diào)查公司的立法現(xiàn)狀,希望其發(fā)展及立法模式,能對(duì)我國的信息調(diào)查公司的發(fā)展提供更多借鑒。第四部分是本文的重要部分,是對(duì)我國信息調(diào)查公司的規(guī)范化發(fā)展的建議。包括在主體規(guī)制、公司的運(yùn)行機(jī)制以及監(jiān)督上的規(guī)范。
[Abstract]:Information investigation companies (commonly known as "private detectives") are still in the initial stage of development in our country, and still belong to the category of new things, so that the academic and practical departments have been debating the issue of its retention or abolition. Along with the strong market demand, the information investigation company has the tendency to develop gradually, but the bias of cognition and the lack of the system make the development of the industry disorderly, resulting in a lot of negative effects. Based on the current situation of information investigation companies in China and the experiences and lessons from abroad, this paper makes a deep discussion on the legal orientation, operational norms and industry supervision of information investigation companies from the normative level. To provide the guarantee for the benign development of the information investigation company of our country. So this paper mainly studies the subject from four aspects: the first part expounds the theoretical basis of the information investigation company, and analyzes the meaning, origin, background and current situation of the information investigation company. This chapter allows us to have a preliminary understanding of the information research company, and his practice in Ningbo is elaborated in detail. The second part analyzes the deficiency of the information investigation company in the development process of our country. As far as the development of information investigation companies in our country is concerned, the information investigation companies in our country have been questioned because of their legitimacy, mainly because of their conflicts with investigation rights, privacy, and personal safety. The department stated that this kind of conflict does not exist. The specific problems of the information investigation company are reflected in the company's operational norms and the lack of supervision. The third part is about the experience of information investigation companies. Through the development of information investigation companies abroad and the legislation status of information investigation companies in several important countries in foreign countries, we hope that its development and legislative model can provide more reference for the development of information investigation companies in our country. The fourth part is an important part of this paper, is to our country information investigation company standardization development suggestion. Including the main regulation, the company's operational mechanism and supervision of the norms.
