【摘要】：隨著我國各類專車軟件的出現(xiàn),專車服務(wù)逐漸興起并在市場中占據(jù)一席之地,影響著公眾的生活,但是由于缺乏具體的法律規(guī)制,對于專車服務(wù)的合法性以及運(yùn)營模式一直存在爭議。在當(dāng)前互聯(lián)網(wǎng)+的大背景下,為了實(shí)現(xiàn)共享經(jīng)濟(jì),充分挖掘出租汽車客運(yùn)服務(wù)的潛力,2016年7月28日,交通部聯(lián)合工信部等七個部門正式頒布《網(wǎng)絡(luò)預(yù)約出租汽車經(jīng)營服務(wù)管理暫行辦法》,對專車服務(wù)的各項(xiàng)內(nèi)容進(jìn)行具體的法律規(guī)制,具有重大的意義。從專車服務(wù)的概念及運(yùn)營模式入手,分析其在運(yùn)行中存在的問題,并結(jié)合美國對于Uber的規(guī)制辦法對我國專車服務(wù)法律規(guī)制的完善提出建議。
[Abstract]:With the emergence of all kinds of special car software in our country, the special car service gradually rises and occupies a place in the market, which affects the life of the public, but due to the lack of specific legal regulation, There has been controversy over the legality of the special-car service and the mode of operation. In the context of the current Internet, in order to realize the sharing economy and fully tap the potential of taxi passenger transport services, on July 28, 2016, It is of great significance that seven departments, such as the Ministry of Communications and the Ministry of Industry and Information, formally promulgate the interim measures for the Management of Network booking Taxi Service, and make specific legal regulations on the contents of the special car service. Starting with the concept and operation mode of the special car service, this paper analyzes the problems existing in its operation, and puts forward some suggestions on the perfection of the legal regulation of the special car service in our country in combination with the regulations of the United States for Uber.
